1Subsection 3(4) of New Brunswick Regulation 97-145 under the Municipalities Act is amended by striking out “made to” and substituting “made to or a withdrawal from”.
2Subsection 4(3) of the Regulation is amended by striking out “made to” and substituting “made to or a withdrawal from”.
3Section 5 of the Regulation is amended
(a) by repealing subsection (4) and substituting the following:
5(4)Money held in a service or utility operating reserve fund established under subsection (1) shall be used for no purpose other than the payment of operating expenses.
(b) in subsection (5) by striking out “made to” and substituting “made to or a withdrawal from”.
4Section 6 of the Regulation is amended
(a) by repealing subsection (3) and substituting the following:
6(3)Money held in a service or utility capital reserve fund shall be used for no purpose other than the payment of capital expenses.
(b) in subsection (4) by striking out “made to” and substituting “made to or a withdrawal from”.
5Section 6.1 of the Regulation is amended
(a) by repealing subsection (3) and substituting the following:
6.1(3)Money held in a generation facility operating reserve fund shall be used for no purpose other than the payment of operating expenses.
(b) in subsection (4) by striking out “made to” and substituting “made to or a withdrawal from”.
6Section 6.2 of the Regulation is amended
(a) by repealing subsection (2) and substituting the following:
6.2(2)Money held in a generation facility capital reserve fund shall be used for no purpose other than the payment of capital expenses.
(b) in subsection (3) by striking out “made to” and substituting “made to or a withdrawal from”.
