Regional Health Authorities Act
(O.C. 2012-33)

Under section 71 of the Regional Health Authorities Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Board Regulation - Regional Health Authorities Act.
Definitions
2The following definitions apply in this Regulation.
“Act” means the Regional Health Authorities Act.(Loi)
“mission statement” means a summary statement adopted by a board that outlines the general goals and objectives of a regional health authority in relation to services rendered to patients, teaching, research and health promotion.(déclarations d’objectifs généraux)
Eligibility
3(1)The following persons are not eligible to be appointed or elected as members of a board established under subsection 20(1) of the Act:
(a) an employee of a regional health authority;
(b) a person who has privileges with a regional health authority;
(c) an employee with the Department of Health;
(d) a member of the Legislative Assembly, the House of Commons of Canada or the Senate;
(e) a director, officer or employee of Ambulance New Brunswick Inc.;
(f) an employee, the chief executive officer or a member of the New Brunswick Health Council;
(g) a director, officer or employee of FacilicorpNB Ltd.;
(h) a judge of the Court of Appeal, The Court of Queen’s Bench of New Brunswick or the Provincial Court; and
(i) a person who is ineligible to vote under section 8.
3(2)A person is not eligible to be appointed as a member of a board under subparagraph 20(1)(a)(i) of the Act unless the person has been ordinarily resident in the health region for which the regional health authority is established for at least six months immediately before the appointment.
3(3)A person is not eligible to be elected as a member of a board under subparagraph 20(1)(a)(ii) of the Act unless the person has been ordinarily resident in the subregion of the health region for which the election is held for at least six months immediately before the day of polling.
3(4)A member of a board ceases to be eligible to hold office on a board if he or she ceases to be ordinarily resident
(a) in the health region for which he or she was appointed, or
(b) in the subregion for which he or she was elected.
3(5)If one or more religious orders own, in whole or in part, hospital facilities that are operated by a regional health authority, one of the persons appointed under subparagraph 20(1)(a)(i) of the Act shall be from the names submitted by the religious orders.
Accepting office
4(1)A person elected to a board shall accept office by subscribing to the oath of office in the form provided by the Minister at the first meeting of the board after the day of polling and shall remain in office until his or her successor on the board subscribes to the oath of office.
4(2)A member of a board shall accept in writing any mission statement approved by the board and the person shall serve on the board in accordance with the spirit and intent of the mission statement.
Meetings
5(1)A board shall meet a minimum of four times per year.
5(2)A board shall ensure that the minutes of its meetings are made available in both official languages to members of the public.
5(3)Subsection (2) does not apply to minutes that derive from portions of a meeting that are not open to members of the public.
Subregions
6(1)For the purposes of the election of members of a board, Health Region A and Health Region B established under section 15 of the Act are each divided into eight subregions described and named in Schedule A.
6(2)Subject to subsection (3), the community names listed in Schedule A are
(a) in the case of a municipality or rural community continued or created in a regulation under the Municipalities Act, the name identified in that regulation;
(b) in the case of the municipality created under the Edmundston Act, 1998, the name of the municipality identified in that Act; and
(c) in all other cases, the names of the communities identified in the assignment of civic addresses under the Emergency 911 Act and the regulations under that Act.
6(3)A community name listed in Schedule A may refer to a part of a community referred to in paragraph (2)(a), (b) or (c).
6(4)A reference to “DSL de” in a community name listed in Schedule A is not a reference to a local service district established in the Local Service Districts Regulation -Municipalities Act.
Elections
7(1)An election for members of a board shall be held in conjunction with the quadrennial elections held under the Municipalities Act.
7(2)One member shall be elected from each subregion described and named in Schedule A.
7(3)Only a person who is eligible to vote in a subregion may nominate a candidate in an election for a member of a board for that subregion.
Eligibility for voting
8(1)Subject to subsection (2), a person is eligible to vote in an election for a member of a board if he or she has been ordinarily resident in the Province for a period of at least 40 days immediately before the day of polling and, on the day of polling, he or she is a Canadian citizen and has attained 18 years of age.
8(2)The following persons are ineligible to vote:
(a) the Municipal Electoral Officer; and
(b) a person who is disqualified from voting under a law relating to the disqualification of electors for corrupt or illegal practices.
8(3)Subject to subsection (5), a person who is eligible to vote in an election for a member of a board is only entitled to vote in the subregion in which the person is ordinarily resident on the day of polling.
8(4)In an election for a member of a board, a person who is ordinarily resident in subregion 1 or 2 of Health Region A or B on the day of polling shall, before voting, declare the board in respect of which he or she intends to vote.
8(5)A person referred to in subsection (4) is only entitled to vote in respect of the board for which he or she declares an intention to vote.
Death of candidate
9An election for a member of a board shall continue despite the death of a candidate for election after the close of nominations and before the polls close.
Appointment of elected member
10Despite subsection 7(2), the following circumstances are prescribed for the purposes of subsection 20(5.2) of the Act:
(a) no candidate is nominated for an elected position on the board; and
(b) an elected candidate withdraws or dies before taking office as a member.
Adopting provisions of the Municipal Elections Act
11(1)Subject to subsections (2) to (11), except for provisions that are inconsistent with the Act or this Regulation, the provisions of the Municipal Elections Act and the regulations under that Act are adopted for the purposes of and apply with the necessary modifications to an election for members of a board.
11(2)The following provisions of the Municipal Elections Act are not adopted and do not apply to an election for members of a board:
(a) the definition “officer of a municipality” in section 1;
(b) section 3;
(c) section 3.1;
(d) section 9;
(e) subsection 11(3.2);
(f) section 13;
(g) paragraph 15(2)(c);
(h) subsections 17(5) and (6);
(i) section 18;
(j) paragraph 20(1)(a.1);
(k) subsection 21(5);
(l) section 31.2;
(m) subparagraph 39.3(6)(a)(ii);
(n) paragraph 39.3(11)(b);
(o) section 46;
(p) subsection 48(2);
(q) section 56; and
(r) section 57.
11(3)The following provisions of the Municipal Elections Act are not adopted and do not apply to an election for members of a board except in the case of a by-election called under section 42.1 of that Act:
(a) subsection 11(5);
(b) paragraph 15(1)(b);
(c) subsection 28(3); and
(d) section 44.
11(4)Except in paragraph 22(2)(b) of the Municipal Elections Act and subject to subsection (7), references to “municipality” in the provisions of the Municipal Elections Act adopted under subsection (1) shall be read as references to “subregion”.
11(5)Any reference to a plebiscite or to a question under a plebiscite in sections 14 and 31.3, paragraphs 32(3)(d) and 51(a) and subsections 55(3) and (4) of the Municipal Elections Act as adopted under subsection (1) is struck out.
11(6)The reference to “section 13” in subsection 14(2) of the Municipal Elections Act, as adopted under subsection (1), shall be read as a reference to “section 8 of the Board Regulation - Regional Health Authorities Act.
11(7)Section 22.1 of the Municipal Elections Act, as adopted under subsection (1), shall be read as follows:
22.1No person who is a candidate or a family associate of a candidate may be appointed or act or continue to act as an election officer in any subregion in which that candidate may be elected.
11(8)The reference to “clerk of the affected municipality” in paragraph 41(5)(b) of the Municipal Elections Act, as adopted under subsection (1), shall be read as a reference to “Minister”.
11(9)The reference to “council” in the English version of subsection 53(10) of the Municipal Elections Act, as adopted under subsection (1), shall be read as a reference to “board”.
11(10)The reference to “à une élection municipale” in the French version of subsection 53(11) of the Municipal Elections Act, as adopted under subsection (1), shall be read as a reference to “à une élection dans une sous-région”.
11(11)The references to “the municipality or rural community” in section 3 of the General Regulation - Municipal Elections Act, as adopted under subsection (1), shall be read as references to “the subregion”.
Offences and penalties
12(1)In this section, “adopted provision” means a provision of the Municipal Elections Act that is adopted under subsection 11(1) with the necessary modifications, or is adopted as modified under subsections 11(2) to (11), as the case may be.(disposition adoptée)
12(2)A person who violates or fails to comply with an adopted provision that is listed in Column I of Schedule A of the Municipal Elections Act commits an offence.
12(3)For the purposes of Part II of the Provincial Offences Procedure Act, each offence referred to in Column I of Schedule A of the Municipal Elections Act is punishable as an offence of the category listed in Column II of Schedule A.
13This Regulation shall be deemed to have come into force on December 30, 2011.
