NEW BRUNSWICK
REGULATION 2011-15
under the
Medical Services Payment Act
(O.C. 2011-78)

Section 33.01 of New Brunswick Regulation 84-20 under the
Medical Services Payment Act
is amended
(
a
)
by repealing paragraph (1)(b) and substituting the following:
(
b
)
the Director or his or her designate who shall act as secretary.
(
b
)
by adding after subsection (1) the following:
33.01
(1.1)
The members appointed to the Insured Services Appeal Committee by the Minister shall include
(
a
)
at least one medical practitioner duly registered and licensed under the
Medical Act
, and
(
b
)
at least one person with knowledge of the health care system.
(
c
)
by repealing subsection (3) and substituting the following:
33.01
(3)
The term of appointment of members of the Insured Services Appeal Committee appointed under paragraph (1)(a) shall be for a term of three years and all members shall be eligible for reappointment for two additional terms.
(
d
)
in subsection (5) of the English version by striking out “chairman” and substituting
“chairperson”
;
(
e
)
in subsection (8) of the English version by striking out “chairman” and substituting
“chairperson”
;
(
f
)
by adding after subsection (9) the following:
33.01
(10)
The Insured Services Appeal Committee may adopt such procedures for conducting its business as it sees fit.

Section 33.02 of the Regulation is repealed.

Section 33.03 of the Regulation is repealed.

The Regulation is amended by adding before section 33.1 the following:
33.04
Those persons who are members of the Insured Services Appeal Committee immediately before the commencement of this section constitute the members of the Insured Services Appeal Committee until the expiry of their term.
33.05
Despite subsection 33.01(3) and section 33.04, of the persons who are members of the Insured Services Appeal Committee on the commencement of section 33.04, only the chairperson is eligible for reappointment for an additional term of one year.
