1Section 2 of New Brunswick Regulation 84-124 under the Fish and Wildlife Act is amended by adding the following definition in alphabetical order:
“restraining trap” means a spring driven jaw-type trap intended to hold an animal by the leg and designed to prevent self-mutilation;
2Section 4 of the Regulation is amended
(a) in paragraph (1)(c) in the portion preceding subparagraph (i) by striking out “subsections (1.1)” and substituting “subsections (1.1), (1.11)”;
(b) by adding after subsection (1.1) the following:
4(1.11)A minor’s fur harvester’s licence does not entitle the holder to trap or snare a fur bearing animal without being accompanied by an adult at all times unless the holder
(a) is twelve years of age or over but under sixteen years of age,
(b) successfully completes
(i) a trapper education course completed in the Province approved by the Minister, or
(ii) a trapper education course completed in another province or territory of Canada or a state of the United States of America recognized by the Minister, and
(c) carries proof that he or she has successfully completed the trapper education course.
(c) in subsection (4) by adding after paragraph (f.3) the following:
(f.4) use a trap for the trapping of raccoon during the period from the first day of October to the last Saturday in October, inclusively, unless the trap is a restraining trap prescribed in Schedule A.1 for that wildlife species and is used under the conditions prescribed in Schedule A.1.
(d) by repealing subsection (4.1) and substituting the following:
4(4.1)A holder of a fur harvester’s licence, a rabbit licence, a minor’s fur harvester’s licence or a minor’s rabbit licence shall check every restraining trap, leg hold trap, box trap or leg snare, excluding drowning sets, set or placed by him or her at least once every forty-eight hours after the setting or placing of the restraining trap, leg hold trap, box trap or leg snare and shall immediately remove from the restraining trap, leg hold trap, box trap or leg snare any wildlife taken by it.
(e) in paragraph (4.6)(c) by striking out “a person who is nineteen years of age or over” and substituting “an adult”.
3Subsection 4.02(1) of the Regulation is amended by striking out “removing the bobcat from the trap or snare” and substituting “immediately upon taking possession of a bobcat”.
4The Regulation is amended by adding, after Schedule A, the attached Schedule A.1.
5Schedule B of the Regulation is repealed and the attached Schedule B is substituted.
Commencement
6Paragraph 2(b) of this Regulation comes into force on September 1, 2011.
