1New Brunswick Regulation 82-218 under The Residential Tenancies Act is amended by adding after section 4 the following:
4.1A notice to quit under subsection 5(4) or 6(8) of the Act shall be in Form 4.
2Section 8 of the Regulation is repealed.
3Section 10 of the Regulation is amended by striking out “shall be in Form 6 or Form 6.1 as the case may be” and substituting “shall be in Form 6”.
4The Regulation is amended by adding after section 14 the following:
14.1If the rent was given in the form of a cheque or other negotiable instrument that was subsequently dishonoured and a late payment fee may be charged by the landlord under section 19.1 of the Act, the amount of the late payment fee is the amount of the NSF (not sufficient funds) charges
(a) that were charged by a financial institution to the landlord as a result of the dishonouring of the instrument, and
(b) that are proved by the landlord by a receipt or statement from the financial institution.
5Section 15 of the Regulation is repealed.
6Section 17.1 of the Regulation is amended by striking out “For the purposes of subsections 6(6.1) and 15(4.1) of the Act” and substituting “For the purposes of subsection 6(6.1), paragraph 8.02(b) and subsection 15(4.1) of the Act”.
7Form 4 of the Regulation is repealed and the attached Form 4 is substituted.
8Form 5 of the Regulation is repealed and the attached Form 5 is substituted.
9Form 6 of the Regulation is repealed and the attached Form 6 is substituted.
10Form 6.1 of the Regulation is repealed.
11Form 9 of the Regulation is repealed and the attached Form 9 is substituted.
12This Regulation comes into force on April 1, 2010.
