Apprenticeship and Occupational Certification Act
Filed August 23, 2010
1Schedule A of New Brunswick Regulation 97-125 under the Apprenticeship and Occupational Certification Act is repealed and the attached Schedule A is substituted.
2Schedule C of the Regulation is amended
(a) by repealing the heading “CONSTRUCTION LINEMAN OCCUPATION” preceding section 18;
(b) by repealing section 18 and its subheadings;
(c) in paragraph 25(4)(b) by striking out “7,200 hours” and substituting “5,400 hours”;
(d) by repealing the heading “FIREFIGHTER OCCUPATION” preceding section 28;
(e) by repealing section 28 and its subheadings;
(f) by adding after section 31 the following:
HEAVY EQUIPMENT OPERATOR
Definition of “heavy equipment”
31.1(1)In this section, “heavy equipment” means earth-moving equipment, including
(a) a bulldozer,
(b) an excavator,
(c) a backhoe, including a tractor loader backhoe,
(d) a grader,
(e) a loader, and
(f) a roller compactor.
Scope of the occupation
31.1(2)The heavy equipment operator occupation includes
(a) the performing of routine inspection and service procedures;
(b) the carrying out of checks before the operation of heavy equipment and continual visual checks during operation;
(c) the operating of heavy equipment to move, load, unload and grade materials during construction and related activities;
(d) the preparing or dismantling of heavy equipment and heavy equipment components for transporting;
(e) the maintaining of records; and
(f) the interpreting of information on grade stakes and drawings.
Qualifications for apprenticeship
31.1(3)No person shall be registered as an apprentice in the heavy equipment operator occupation unless the person
(a) has successfully passed Grade 12 or its equivalent as determined by the Board,
(b) is physically able to perform all of the duties of the heavy equipment operator occupation, and
(c) is willing to enter into an apprenticeship agreement in the heavy equipment operator occupation with an employer or a joint apprenticeship training committee.
Hours of apprenticeship
31.1(4)In addition to any other requirements under a plan of apprenticeship, in order to obtain a diploma of apprenticeship an apprentice shall have acquired a total of 7,200 hours of on-the-job training and work experience.
Requirements of candidates for certificates of qualification
31.1(5)No person shall be a candidate for a certificate of qualification in the heavy equipment operator occupation unless the person
(a) completes and files with the Director the application provided by the Director,
(b) proves to the satisfaction of the Director that experience has been gained equivalent to 9,000 hours of practical experience in the heavy equipment operator occupation or that the person has successfully completed an apprenticeship program in that occupation under the Act, and
(c) pays the fee for the examination for the certification of qualification.
Examinations
31.1(6)The examination for a certification of qualification in the heavy equipment operator occupation shall be a written examination.
31.1(7)The mark required to successfully pass the examination is 70%.
(g) by adding after section 37 the following:
IRONWORKER (REINFORCING) OCCUPATION
Scope of the occupation
37.1(1)The ironworker (reinforcing) occupation includes
(a) the cutting, bending, layout and placement of reinforcing rods, wire fabric and composite materials;
(b) the placing and stressing of post-tensioning systems;
(c) the rigging of loads and directing of crane operators when installing reinforcing and post-tensioning components;
(d) the application of sealants, where applicable;
(e) the edging preparation, tacking and burning of ferrous and non-ferrous metals;
(f) the selecting, erecting and dismantling of scaffolding; and
(g) the interpreting of blueprints and symbols.
Qualifications for apprenticeship
37.1(2)No person shall be registered as an apprentice in the ironworker (reinforcing) occupation unless the person
(a) has successfully passed Grade 12 or its equivalent as determined by the Board,
(b) is physically able to perform all of the duties of the ironworker (reinforcing) occupation, and
(c) is willing to enter into an apprenticeship agreement in the ironworker (reinforcing) occupation with an employer or a joint apprenticeship training committee.

IRONWORKER (STRUCTURAL/ORNAMENTAL) OCCUPATION
Scope of the occupation
37.2(1)The ironworker (structural/ornamental) occupation includes
(a) the erecting, dismantling and repairing or replacing of all structural ironwork;
(b) the erecting and dismantling of pre-cast and prestressed concrete;
(c) the installation of conveyors and other material handling systems;
(d) the installation of curtain walls and ornamental ironwork;
(e) the rigging of machinery and heavy equipment;
(f) the edging preparation, tacking and burning of ferrous and non-ferrous metals;
(g) the selecting, erecting and dismantling of scaffolding; and
(h) the interpreting of blueprints and symbols.
Qualifications for apprenticeship
37.2(2)No person shall be registered as an apprentice in the ironworker (structural/ornamental) occupation unless the person
(a) has successfully passed Grade 12 or its equivalent as determined by the Board,
(b) is physically able to perform all of the duties of the ironworker (structural/ornamental) occupation, and
(c) is willing to enter into an apprenticeship agreement in the ironworker (structural/ornamental) occupation with an employer or a joint apprenticeship training committee.

LANDSCAPE-HORTICULTURIST OCCUPATION
Scope of the occupation
37.3(1)The landscape-horticulturist occupation includes
(a) the installation and maintenance of landscape features, such as lawns, gardens, patios, driveways, retaining walls, stairways, water features and irrigation systems;
(b) the installation, maintaining and pruning of trees, shrubs and other plants;
(c) the fertilizing of lawns and gardens;
(d) the identifying of plants;
(e) the aerating and dethatching of turf;
(f) the maintaining of pest control;
(g) the operating, maintaining and safe use of all landscaping equipment;
(h) the using of grading and drainage instruments; and
(i) the interpreting of plans and drawings.
Qualifications for apprenticeship
37.3(2)No person shall be registered as an apprentice in the landscape-horticulturist occupation unless the person
(a) has successfully passed Grade 12 or its equivalent as determined by the Board,
(b) is physically able to perform all of the duties of the landscape-horticulturist occupation, and
(c) is willing to enter into an apprenticeship agreement in the landscape-horticulturist occupation with an employer or a joint apprenticeship training committee.
Hours of apprenticeship
37.3(3)In addition to any other requirements under a plan of apprenticeship, in order to obtain a diploma of apprenticeship an apprentice shall have acquired a total of 5,400 hours of on-the-job training and work experience.
Requirements of candidates for certificates of qualification
37.3(4)No person shall be a candidate for a certificate of qualification in the landscape-horticulturist occupation unless the person
(a) completes and files with the Director the application provided by the Director,
(b) proves to the satisfaction of the Director that experience has been gained equivalent to 7,200 hours of practical experience in the landscape-horticulturist occupation or that the person has successfully completed an apprenticeship program in that occupation under the Act, and
(c) pays the fee for the examination for the certification of qualification.
Examinations
37.3(5)The examination for a certification of qualification in the landscape-horticulturist occupation shall be a written examination.
37.3(6)The mark required to successfully pass the examination is 70%.
(h) by repealing section 38 and its subheadings and substituting the following:
Scope of the occupation
38(1)The lather (interior systems mechanic) occupation includes
(a) the planning and scheduling of work;
(b) the preparing of the worksite;
(c) the diagnosing and repairing of any problems relating to lather-interior systems;
(d) the interpreting of blueprints, shop drawings and specifications;
(e) the installation of drywall, metal lath and stucco wire;
(f) the cutting, preparing, welding, fabrication or otherwise handling of all lath materials;
(g) the installation of access flooring systems;
(h) the erecting of non-load and load bearing steel assemblies;
(i) the installation of wall systems and components;
(j) the installation of ceiling systems;
(k) the installation of sound barriers and lead radiation shielding;
(l) the installation of smoke and fire barriers;
(m) the installation of insulation and membranes; and
(n) the preparing and installing of material for exterior finishes.
Qualifications for apprenticeship
38(2)No person shall be registered as an apprentice in the lather (interior systems mechanic) occupation unless the person
(a) has successfully passed Grade 12 or its equivalent as determined by the Board,
(b) is physically able to perform all of the duties of the lather (interior systems mechanic) occupation, and
(c) is willing to enter into an apprenticeship agreement in the lather (interior systems mechanic) occupation with an employer or a joint apprenticeship training committee.
Hours of apprenticeship
38(3)In addition to any other requirements under a plan of apprenticeship, in order to obtain a diploma of apprenticeship an apprentice shall have acquired a total of 5,400 hours of on-the-job training and work experience.
Requirements of candidates for certificates of qualification
38(4)No person shall be a candidate for a certificate of qualification in the lather (interior systems mechanic) occupation unless the person
(a) completes and files with the Director the application provided by the Director,
(b) proves to the satisfaction of the Director that experience has been gained equivalent to 7,200 hours of practical experience in the lather (interior systems mechanic) occupation or that the person has successfully completed an apprenticeship program in that occupation under the Act, and
(c) pays the fee for the examination for the certification of qualification.
Examinations
38(5)The examination for a certification of qualification in the lather (interior systems mechanic) occupation shall be a written examination.
38(6)The mark required to successfully pass the examination is 70%.

LOCKSMITH OCCUPATION
Scope of the occupation
38.1(1)The locksmith occupation includes
(a) the modifying, recombining, repairing or installation of mechanical locking devices and electronic based locking systems;
(b) the repairing, recoding, servicing, installation, manipulating or bypassing of a mechanical or electronic locking device for controlled access or egress to premises, safes, vaults, lock boxes, automatic teller machines or other devices for safeguarding areas where access is meant to be limited;
(c) the operating of a mechanical or electronic locking device, safe or vault by means other than those intended by the manufacturer of such locking devices, safes or vaults; and
(d) the providing of technical advice and consulting in regards to the selection of hardware and locking systems of mechanical or electronic locking devices and electronic security systems.
Requirements of candidates for certificates of qualification
38.1(2)No person shall be a candidate for a certificate of qualification in the locksmith occupation unless the person
(a) completes and files with the Director the application provided by the Director,
(b) proves to the satisfaction of the Director that experience has been gained equivalent to 9,000 hours of practical experience in the locksmith occupation,
(c) pays the fee for the examination for the certification of qualification, and
(d) attaches to the application a criminal record check issued not more than six months prior to the application.
Examinations
38.1(3)The examination for a certification of qualification in the locksmith occupation shall be a written examination.
38.1(4)The mark required to successfully pass the examination is 70%.
(j) by repealing the heading “MARINE ELECTRICIAN OCCUPATION” preceding section 40;
(k) by repealing section 40 and its subheadings;
(l) in subsection 41.1(3)
(i) in paragraph (b) by striking out “and” at the end of the paragraph;
(ii) in paragraph (c) by striking out the period at the end of the paragraph and substituting a comma followed by “and”;
(iii) by adding after paragraph (c) the following:
(d) is the holder of a valid class 5 driver’s licence issued under the Motor Vehicle Act.
(m) in subsection 41.1(5)
(i) in paragraph (b) by striking out “and” at the end of the paragraph;
(ii) in paragraph (c) by striking out the period at the end of the paragraph and substituting a comma followed by “and”;
(iii) by adding after paragraph (c) the following:
(d) is the holder of a valid class 5 driver’s licence issued under the Motor Vehicle Act.
(n) by repealing the heading “POWER SYSTEM OPERATOR OCCUPATION” preceding section 48;
(o) by repealing section 48 and its subheadings;
(p) by repealing the heading “PRODUCTION EQUIPMENT MECHANIC OCCUPATION” preceding section 50;
(q) by repealing section 50 and its subheadings;
(r) in section 59
(i) by repealing subsection (2);
(ii) by repealing subsection (2.1);
(iii) in paragraph (4)(b) by striking out “7,200 hours” and substituting “3,600 hours”;
(s) by adding after section 67 the following:
TILESETTER OCCUPATION
Scope of the occupation
67.1(1)The tilesetter occupation includes
(a) the covering, repairing and decorating exterior and interior walls, ceilings, floors and other surfaces using ceramic, mosaic, marble and quarry tile, slate, stone or granite slabs and terrazzo;
(b) the reading and interpreting of architectural drawings and materials specifications to determine layout, finish and installation;
(c) the selecting, mixing, applying and spreading of mortars, grouts, mastics and other adhesives for the preparation and installation of materials;
(d) the reinforcing or building of an underbase as required to support the finish material;
(e) the finishing of material by grouting, surfacing and polishing by hand or machine; and
(f) the installation of pre-cast terrazzo, granite or marble units.
Requirements of candidates for certificates of qualification
67.1(2)No person shall be a candidate for a certificate of qualification in the tilesetter occupation unless the person
(a) completes and files with the Director the application provided by the Director,
(b) proves to the satisfaction of the Director that experience has been gained equivalent to 9,000 hours of practical experience in the tilesetter occupation, and
(c) pays the fee for the examination for the certification of qualification.
Examinations
67.1(3)The examination for a certification of qualification in the tilesetter occupation shall be a written examination.
67.1(4)The mark required to successfully pass the examination is 70%.
(t) by adding after section 69 the following:
UNDERGROUND HARDROCK MINER OCCUPATION
Scope of the occupation
69.1(1)The underground hardrock miner occupation includes
(a) the inspecting of work areas for safety hazards;
(b) the scaling of loose rock;
(c) the installation of wooden staging for work platforms;
(d) the operating of stoppers and jacklegs;
(e) the installation of ground support using mechanized equipment;
(f) the safe handling and use of explosives;
(g) the operating of scooptrams, haul trucks, scissor lift trucks and mine utility vehicles;
(h) the applying of Lock Out and Workplace Hazardous Materials Information System procedures;
(i) the applying of the Occupational Health and Safety Act as it pertains to the mining industry; and
(j) the installation of mine services, including air and water lines and ventilation ducting.
Qualifications for apprenticeship
69.1(2)No person shall be registered as an apprentice in the underground hardrock miner occupation unless the person
(a) has successfully passed Grade 10 or its equivalent as determined by the Board,
(b) is physically able to perform all of the duties of the underground hardrock miner occupation,
(c) is willing to enter into an apprenticeship agreement in the underground hardrock miner occupation with an employer or a joint apprenticeship training committee, and
(d) is 18 years of age or older.
Hours of apprenticeship
69.1(3)In addition to any other requirements under a plan of apprenticeship, in order to obtain a diploma of apprenticeship an apprentice shall have acquired a total of 4,500 hours of on-the-job training and work experience.
Requirements of candidates for certificates of qualification
69.1(4)No person shall be a candidate for a certificate of qualification in the underground hardrock miner occupation unless the person
(a) completes and files with the Director the application provided by the Director,
(b) proves to the satisfaction of the Director that experience has been gained equivalent to 6,300 hours of practical experience in the underground hardrock miner occupation or that the person has successfully completed an apprenticeship program in that occupation under the Act, and
(c) pays the fee for the examination for the certificate of qualification.
Examinations
69.1(5)The examination for a certificate of qualification in the underground hardrock miner occupation shall be a written examination.
69.1(6)The mark required to successfully pass the examination is 70%.
