1Section 3 of New Brunswick Regulation 84-133 under the Fish and Wildlife Act is amended
(a) by repealing subsection (1) and substituting the following:
3(1)Subject to subsection (3), hunting licences may be issued as follows:
(a) subject to section 3.02, subsection 11.1(1) and section 11.2, a class I licence, the fee for which is one hundred and seventy-three dollars to a non-resident sixteen years of age or over, authorizes the holder to hunt antlered deer, varying hare, groundhog, coyote, crow, spruce grouse, ruffed grouse, cormorant and migratory game birds;
(b) subject to subsection (1.4), a class II licence, the fee for which is seventy-two dollars to a non-resident fourteen years of age or over, authorizes the holder to hunt varying hare, groundhog, coyote, crow, spruce grouse, ruffed grouse, cormorant and migratory game birds;
(c) subject to subsections (1.1) and (4.1) and sections 3.02, 11.1 and 11.2, a class III licence, the fee for which is twenty-nine dollars to a resident sixteen years of age or over, authorizes the holder to hunt
(i) antlered deer, varying hare, groundhog, coyote, crow, spruce grouse, ruffed grouse, cormorant and migratory game birds,
(ii) antlerless deer in accordance with section 3.1, and
(iii) notwithstanding subsection 15(1) of the Fur Harvesting Regulation - Fish and Wildlife Act, being New Brunswick Regulation 84-124 under the Fish and Wildlife Act, varying hare with a hound or hounds, except at night;
(d) a class IV licence, the fee for which is fourteen dollars to a resident sixteen years of age or over, authorizes the holder to hunt
(i) varying hare, groundhog, coyote, crow, spruce grouse, ruffed grouse, cormorant and migratory game birds, and
(ii) notwithstanding subsection 15(1) of the Fur Harvesting Regulation, being New Brunswick Regulation 84-124 under the Fish and Wildlife Act, varying hare with a hound or hounds, except at night;
(e) a minor’s licence, the fee for which is seven dollars to a resident between the ages of fourteen and sixteen years, authorizes the holder while accompanied by an adult to hunt varying hare, groundhog, coyote, crow, spruce grouse, ruffed grouse, cormorant and migratory game birds;
(f) a varmint licence, the fee for which is seventeen dollars to a non-resident sixteen years of age or over, authorizes the holder to hunt groundhog, coyote, cormorant and crow;
(g) a varmint licence, the fee for which is seven dollars to a resident sixteen years of age or over, authorizes the holder to hunt groundhog, coyote, cormorant and crow;
(h) subject to sections 3.02 and 3.2 and subsection 6(2.1), a non-resident bear licence, the fee for which is one hundred and nine dollars to a non-resident sixteen years of age or over, authorizes the holder to hunt bear and coyote;
(i) subject to section 3.02 and subsection 6(2.1), a resident bear licence, the fee for which is twenty-eight dollars to a resident sixteen years of age or over, authorizes the holder to hunt bear and coyote.
(b) by repealing subsection (2) and substituting the following:
3(2)Notwithstanding subsection (1), where a person who applies for a hunting licence has attained his or her sixty-fifth birthday before applying for a licence, the fee to be paid by the applicant
(a) for a class III licence shall be fourteen dollars,
(b) for a class IV licence shall be eight dollars,
(c) for a varmint licence shall be five dollars if the applicant is a resident, and
(d) for a resident bear licence shall be fourteen dollars.
2This Regulation comes into force on June 1, 2009.
