1Section 2 of New Brunswick Regulation 2008-112 under the Gaming Control Act is amended
(a) in the definition “approved premises” by striking out “, on and after April 1, 2009,”;
(b) by adding the following definitions in alphabetical order:
“casino” means a casino operated by a person under an agreement with the Corporation.(casino)
“casino market area” means the area within an 80 kilometre radius within New Brunswick of a casino located in the Province.(zone de marché d’un casino)
2Subsection 9(3) of the English version of the Regulation is amended by striking out “lottery” and substituting “gaming”.
3Subsection 10(2) of the Regulation is repealed and the following is substituted:
10(2)ALC shall ensure that an approved premises in which a video gaming devices is placed, other than those referred to in subsection (1), is one of the following:
(a) Category 1 approved premises, in which a minimum of 15 to a maximum of 25 video gaming devices are permitted; or
(b) Category 2 approved premises, in which not more than 10 video gaming devices are permitted.
4Subsection 11(1) of the Regulation is repealed and the following is substituted:
11(1)The amount of commission that is payable by ALC to a siteholder is as follows:
(a) for Category 1 approved premises - 15% of the net income of each video gaming device; and
(b) for Category 2 approved premises - 20% of the net income of each video gaming device.
5The Regulation is amended by adding after section 11 the following:
General restrictions
11.1On and after April 1, 2010, ALC shall ensure that
(a) not more than 300 approved premises have video gaming devices;
(b) not more than 2000 video gaming devices are placed in approved premises;
(c) not more than 20 approved premises have a minimum of 15 to a maximum of 25 video gaming devices;
(d) no site is permitted that is presented as or has the appearance of a single gaming destination but which consists of more than 3 adjacent Category 1 or Category 2 approved premises;
(e) within a casino market area,
(i) not more than 400 video gaming devices are placed in approved premises;
(ii) not more than 4 approved premises have a minimum of 15 to a maximum of 25 video gaming devices; and
(iii) no site is permitted that is presented as or has the appearance of a single gaming destination but which consists of adjacent Category 1 or Category 2 approved premises.
6This Regulation comes into force on April 1, 2009.
