1Subsection 4(2) of New Brunswick Regulation 2008-113 under the Gaming Control Act is amended by striking out “Despite sections 6 and 7, from” and substituting “From”.
2Section 5 of the English version of the Regulation is amended by striking out “video lottery siteholder” and substituting “ “video lottery siteholder” ”.
3Section 6 of the Regulation is amended
(a) by repealing subsection (2) and substituting the following:
6(2)For an application made in respect of a registration period that commences on or after April 1, 2009, the application shall be accompanied by
(a) a letter from ALC confirming the number of video gaming devices it intends to supply to the premises if registration is granted, and
(b) an application fee of
(i) $3200, if the number of video gaming devices to be supplied is at least 15 and not more than 25, and
(ii) $1200, if the number of video gaming devices to be supplied is not more than 10.
(b) by adding after subsection (2) the following:
6(3)For a subsequent renewal of a registration after an application has been made under subsection (2), the application fee is as follows:
(a) $3000, if the number of video gaming devices to be supplied is at least 15 and not more than 25, and
(b) $1000, if the number of video gaming devices to be supplied is not more than 10.
4The Regulation is amended by adding after section 7 the following:
Temporary registration
7.1The Registrar may grant a registration on or after October 1, 2008, and before March 31, 2009, to expire on March 31, 2009, to an applicant who is not deemed to be registered under subsection 4(2), if the application is accompanied by a letter from ALC confirming the number of video gaming devices it intends to supply to the premises if registration is granted.
5Section 9 of the Regulation is amended by striking out “10” and substituting “9.1”.
6The Regulation is amended by adding after section 9 the following:
Licensed premises
9.1Every registered video lottery siteholder shall occupy the premises in respect of which the registration is granted and shall hold and continue to hold a valid licence under the Liquor Control Act to operate the premises as a licensed premises under that Act.
7Section 17 of the Regulation is amended by adding “8,” after “5,”.
