REGULATION 2009-142

Provincial Offences Procedure Act

1Section 3 of New Brunswick Regulation 91-50 under the Provincial Offences Procedure Act is amended
(a) in subsection (1) by adding after paragraph (e.6) the following:
(e.7) an offence under paragraph 3(d.1) of the Smoke-free Places Act;
(b) in subsection (2)
(i) in paragraph (f) by striking out “and” at the end of the paragraph;
(ii) by adding after paragraph (f) the following:
(f.1) in respect of a prescribed offence specified in paragraph (1)(e.7), peace officers as defined in the Motor Vehicle Act; and
2Schedule A of the Regulation is amended by adding after the portion for the Quarriable Substances Act the following:

3This Regulation comes into force on January 1, 2010.
