Under section 45 of the
Economic and Social Inclusion Act
, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1
This Regulation may be cited as the
General Regulation -
Economic and Social Inclusion Act
.
Definition of “Act”

In this Regulation, “Act” means the
Economic and Social Inclusion Act
.
Regions
3
For the purposes of subsection 32(2) of the Act, the following geographic areas are prescribed:
(
a
)
Region 1 - Albert County; Westmorland County; the parish of Saint-Paul in Kent County;
(
b
)
Region 2 - Saint John County; Kings County; the parishes of Brunswick, Hampstead, Johnston, Petersville and Wickham, and the village of Cambridge-Narrows in Queens County;
(
c
)
Region 3 - Sunbury County; the Devon Indian Reserve No. 30, the St. Mary’s Indian Reserve No. 24, the Kingsclear Indian Reserve No. 6, the parishes of Saint Marys, New Maryland and Kingsclear, the village of New Maryland and The City of Fredericton in York County; the parishes of Gagetown, Cambridge, Canning, Waterborough and Chipman, and the villages of Gagetown, Minto and Chipman in Queen’s County;

d
)
Region 4 - Madawaska County; the parishes of Drummond and Grand Falls, the village of Drummond and the town of Grand Falls in Victoria County;
(
e
)
Region 5 - Restigouche County;
(
f
)
Region 6 - the Pabineau Indian Reserve No. 11, the parishes of New Bandon, Allardville, Beresford and Bathurst, the villages of Nigadoo, Petit-Rocher and Village de Pointe-Verte, the town Beresford and the City of Bathurst in Gloucester County;
(
g
)
Region 7 - Northumberland County, excluding the parishes of Alnwick, Blissfield and Ludlow, the villages of Doaktown and Neguac, the Tabusintac Indian Reserve No. 9 and the Burnt Church Indian Reserve No. 14;
(
h
)
Region 8 - Charlotte County;
(
i
)
Region 9 - the parishes of Blissfield and Ludlow, and the village of Doaktown in Northumberland County; York County, excluding the Devon Indian Reserve No. 30, the St. Mary’s Indian Reserve No. 24, the Kingsclear Indian Reserve No. 6, the parishes of Saint Marys, New Maryland and Kingsclear, the village of New Maryland and The City of Fredericton;

)
Region 10 - Carleton County; Victoria County, excluding the parishes of Drummond and Grand Falls, the village of Drummond and the town of Grand Falls;
(
k
)
Region 11 - Kent County, excluding the parish of Saint-Paul;
(
l
)
Region 12 - the Tabusintac Indian Reserve No. 9, the Burnt Church Indian Reserve No. 14, the parish of Alnwick and the village of Neguac in Northumberland County; Gloucester County, excluding the Pabineau Indian Reserve No. 11, the villages of Nigadoo, Petit-Rocher and Village de Pointe-Verte, the parishes of New Bandon, Allardville, Beresford and Bathurst, the town of Beresford and the City of Bathurst.
Local plan

For the purposes of paragraph 32(1)(
a
) and section 35 of the Act, a local plan must contain the following information:
(
a
)
the objectives of the Provincial Plan that will be implemented by the group;
(
b
)
the actions that will be taken to meet the objectives referred to in paragraph (
a
);
(
c
)
the time frames within which the actions will be taken;
(
d
)
information that demonstrates that the actions to be taken will address the needs of the entire geographic area in which the group will operate; and
(
e
)
information that demonstrates that the needs of both official linguistic communities have been taken into consideration in the development of the local plan.
Criteria for recognition

For the purposes of paragraph 32(1)(
b
) of the Act, the criteria for recognition of a group as a community inclusion network are as follows:
(
a
)
a governance structure is in place for the group that includes a board composed of at least
(i
)
one person who is an employee within the meaning of the
Civil Service Act
or a member of the Legislative Assembly,
(ii
)
one representative of the business sector,
(iii
)
one representative of the non-profit sector, and
(iv
)
one person who lives in or has lived in poverty;
(
b
)
there is community support for the recognition of the group as a community inclusion network, as demonstrated by two letters of support;
(
c
)
the group has the ability to leverage financial or volunteer resources in the community;
(
d
)
the group has the ability to address the linguistic needs of both official linguistic communities in the geographic area in which the group will operate; and
(
e
)
the group has a procedure in place for financial management that is based on generally accepted accounting practices.
Grounds to suspend or cancel recognition

For the purposes of section 36 of the Act, the Corporation may suspend or cancel the recognition of a group as a community inclusion network if the group
(
a
)
no longer meets the criteria prescribed in section 5,
(
b
)
makes a false statement in any documentation required to be submitted under the Act or this Regulation,
(
c
)
does not address the needs of both official linguistic communities in the geographic area in which the group operates, or
(
d
)
violates or fails to comply with the provisions of the Act or this Regulation.
