Offences respecting driving while suspended
345(1)Every person who drives a motor vehicle upon a highway while the person’s motor vehicle privilege or driving privilege is suspended other than under section 105.1 commits an offence.
345(2)Every person who drives a motor vehicle upon a highway while the person’s driving privilege is suspended under section 105.1 commits an offence.
345(3)If a person’s licence is revoked or suspended and the person’s driving privilege is suspended under section 310.01, 310.02, 310.021, 310.04 or 310.06 and that person violates subsection (1), the peace officer shall detain the motor vehicle that the person was driving at the time of the alleged offence and the motor vehicle shall be impounded for a period of 45 days from the time the vehicle is detained.
345(4)Section 310.2 applies to the detention and impoundment of a motor vehicle under subsection (3).
