Failure to attend or produce records
56(1)On application by the chairperson of the Discipline Committee to The Court of King’s Bench of New Brunswick, a person who has been served a notice under section 55 and who fails to attend or to produce records, documents or other things as required by an order of the chairperson or the Registrar, or who refuses to be sworn or affirmed as a witness or to answer any question the committee directs that person to answer, may be found liable for contempt as if the person were in breach of an order or judgement of The Court of King’s Bench of New Brunswick.
56(2)If the person referred to in subsection (1) who has been served a notice is a member, the failure or refusal may be held by the Discipline Committee to be professional misconduct.
