Procedure before Board
68(1)Subject to subsection 67(2.2) and section 67.1, if a matter is referred to the Board under section 8 or 44.031 or subsection 67(1) or (1.1), the Board shall hear the matter as soon as it can conveniently be arranged.
68(2)The Board shall set a date for a hearing, which, unless the parties consent to a later date, shall be not later than twenty days after the matter was referred to the Board, and shall serve notice of the hearing on the parties at least ten days before the date set.
68(3)The notice of hearing shall contain
(a)
a statement of the time and place of the hearing;
(b)
a reference to the provision of this Act under which the hearing is being held;
(c)
a statement as to where and how further information on the proceedings may be obtained;
(d)
a concise statement of the issue; and
(e)
a statement that, if a party who has been duly notified does not attend at the hearing, the Board may proceed in the party's absence and the party is not entitled to notice of any further proceedings.
68(4)If a person who has been notified of a hearing does not attend, the Board may proceed in the person's absence and the person is not entitled to notice of any further proceedings.
