153(1)A local government may make an application to The Court of King’s Bench of New Brunswick for any of the orders described in subsection (2) if a person
(a)
contravenes or fails to comply with any provision of this Act, the regulations or a by-law under this Act,
(b)
contravenes or fails to comply with any terms or conditions to which a licence issued in accordance with a by-law under this Act is subject, or
(c)
obstructs a person in the exercise of a power or the performance of a duty under this Act.
153(2)In a proceeding under this section, the judge may make
(a)
an order restraining the continuance or repetition of the contravention, failure to comply or obstruction, or
(b)
any other order that is required to enforce a provision in respect of which the action was instituted and as to costs and the recovery of any expense incurred that the judge considers appropriate.
