Proceedings and conviction
150(1)Proceedings for an offence under a by-law shall be commenced in the name of the clerk of the local government or any other person who is designated for that purpose by the council.
150(2)Conviction of a person for an offence under a by-law does not relieve the person from compliance with the by-law and a judge of the Provincial Court may, in addition to the fine imposed, order the person to do any act or thing necessary to comply with the by-law or to remedy the violation, within a specified time.
150(3)A person who fails to comply with an order under subsection (2) within the specified time commits an offence punishable under Part 2 of the
Provincial Offences Procedure Act as a category F offence.
150(4)A person who is convicted of an offence under a by-law may appeal the conviction to The Court of King’s Bench of New Brunswick.
