Members of the Commission
6(1)The members of the Commission, including the chair, shall be appointed by the Lieutenant-Governor in Council for a term not exceeding five years and, subject to subsections (2) and (3), may be reappointed.
6(2)Subject to subsection (3), a person is not eligible to serve as a member of the Commission for more than ten years.
6(3)If a member of the Commission is appointed the chair of the Commission, the person is eligible to be appointed as chair for a term not exceeding five years regardless of how many years the person served as a member prior to their appointment as chair.
6(4)Despite subsections (2) and (3) and subject to section 9, a member of the Commission remains in office after the expiry of their term until the member resigns or is reappointed or replaced.
6(5)Despite subsections (2) and (3) and subject to section 9, a member of the Commission who held office immediately before the commencement of this subsection, other than the chair, continues in office until the member resigns or is reappointed or replaced.
