4No proponent shall carry on an undertaking unless
(a)
the Minister has made a determination that the undertaking may be carried on without the completion of an environmental impact assessment, or
(b)
the Lieutenant-Governor in Council, following the completion of a required environmental impact assessment, has given an approval for the carrying on of the undertaking.
