REGULATION 93-104

Vital Statistics Act

Under section 52 of the Vital Statistics Act, the Lieutenant-Governor in Council makes the following Regulation:
1This Regulation may be cited as the Fees Regulation - Vital Statistics Act.
1.1In this Regulation, “Act” means the Vital Statistics Act.
2016-11
2From February 15, 2016, to April 3, 2016, both dates inclusive, the following fees are prescribed for the purposes of the Act:
(a) for a short form birth certificate
(i) if the application is made through the website of Service New Brunswick..............$40;
(ii) if the application is made in person or by regular mail..............$45;
(b) for a certified marriage or death certificate
(i) if the application is made through the website of Service New Brunswick..............$40;
(ii) if the application is made in person or by regular mail..............$45;
(c) for a long form birth certificate
(i) if the application is made through the website of Service New Brunswick..............$40;
(ii) if the application is made in person or by regular mail..............$45;
(d) for a photographic print of a marriage registration..............$25;
(e) for a search for the registration of a birth, stillbirth, marriage or death (per search period of three consecutive years or less)..............$10;
(f) for a delayed registration of birth, marriage or death (certificate not included)..............$20;
(g) for an amendment to a birth or marriage registration, made as a result of a change of name registered under the Change of Name Act, granted by a court of any jurisdiction or registered in a vital statistics office in any other jurisdiction..............$20;
(h) for re-registration or amendment of a birth registration..............$20;
(i) for any other amendment (certificate not included)..............$20, and
(j) for the provision of any certificate or service referred to in this section on an expedited basis, in addition to any other fee payable under this section..............$50.

2.01From April 4, 2016, to April 2, 2017, both dates inclusive, the following fees are prescribed for the purposes of the Act:
(a) for a short form birth certificate
(i) if the application is made through the website of Service New Brunswick..............$40;
(ii) if the application is made in person or by regular mail..............$45;
(b) for a certified marriage or death certificate
(i) if the application is made through the website of Service New Brunswick..............$40;
(ii) if the application is made in person or by regular mail..............$45;
(c) for a long form birth certificate
(i) if the application is made through the website of Service New Brunswick..............$40;
(ii) if the application is made in person or by regular mail..............$45;
(d) for a photographic print of a marriage registration..............$40;
(e) for a search for the registration of a birth, stillbirth, marriage or death (per search period of three consecutive years or less)..............$10;
(f) for a delayed registration of birth, marriage or death (certificate not included)..............$35;
(g) for an amendment to a birth or marriage registration, made as a result of a change of name registered under the Change of Name Act, granted by a court of any jurisdiction or registered in a vital statistics office in any other jurisdiction..............$20;
(h) for re-registration or amendment of a birth registration..............$20;
(i) for any other amendment (certificate not included)..............$20; and
(j) for the provision of any certificate or service referred to in this section on an expedited basis, in addition to any other fee payable under this section..............$50.

2.02From April 3, 2017, to July 1, 2019, both dates inclusive, the following fees are prescribed for the purposes of the Act:
(a) for a short form birth certificate
(i) if the application is made through the website of Service New Brunswick..............$40;
(ii) if the application is made in person or by regular mail..............$45;
(b) for a certified marriage or death certificate
(i) if the application is made through the website of Service New Brunswick..............$40;
(ii) if the application is made in person or by regular mail..............$45;
(c) for a long form birth certificate
(i) if the application is made through the website of Service New Brunswick..............$40;
(ii) if the application is made in person or by regular mail..............$45;
(d) for a photographic print of a marriage registration..............$40;
(e) for a search for the registration of a birth, stillbirth, marriage or death (per search period of three consecutive years or less)..............$10;
(f) for a delayed registration of birth, marriage or death (certificate not included)..............$50;
(g) for an amendment to a birth or marriage registration, made as a result of a change of name registered under the Change of Name Act, granted by a court of any jurisdiction or registered in a vital statistics office in any other jurisdiction..............$35;
(h) for re-registration or amendment of a birth registration..............$35;
(i) for any other amendment (certificate not included)..............$35; and
(j) for the provision of any certificate or service referred to in this section on an expedited basis, in addition to any other fee payable under this section..............$50.

2.021On and after July 2, 2019, the following fees are prescribed for the purposes of the Act:
(a) for a short form birth certificate
(i) if the application is made through the website of Service New Brunswick..............$40;
(ii) if the application is made in person or by regular mail..............$45;
(iii) if the application under subparagraph (ii) is made as a result of an application to change the sex designation of a person..............nil;
(b) for a certified marriage or death certificate
(i) if the application is made through the website of Service New Brunswick..............$40;
(ii) if the application is made in person or by regular mail..............$45;
(c) for a long form birth certificate
(i) if the application is made through the website of Service New Brunswick..............$40;
(ii) if the application is made in person or by regular mail..............$45;
(iii) if the application under subparagraph (ii) is made as a result of an application to change the sex designation of a person..............nil;
(d) for a photographic print of a marriage registration..............$40;
(e) for a search for the registration of a birth, stillbirth, marriage or death (per search period of three consecutive years or less)..............$10;
(f) for a delayed registration of birth, marriage or death (certificate not included)..............$50;
(g) for an amendment to a birth or marriage registration made as a result of a change of name registered under the Change of Name Act, granted by a court of any jurisdiction or registered in a vital statistics office in any other jurisdiction..............$35;
(h) for re-registration of or an amendment to a birth registration, other than an amendment to a birth registration made as a result of an application to change the sex designation of a person under section 34 or 34.1 of the Act,..............$35;
(i) for an amendment to a birth registration made as a result of an application to change the sex designation of a person under section 34 or 34.1 of the Act ..............nil;
(j) for the issuance of a change of sex designation certificate to a person..............nil;
(k) for any other amendment (certificate not included)..............$35; and
(l) for the provision of any certificate or service referred to in this section on an expedited basis, in addition to any other fee payable under this section..............$50.

2.1(1)Upon receipt of a completed registration of birth form, the Registrar General shall send to a parent of the child one short form birth certificate in respect of the child who has been registered.
2.1(2)No fee is payable in respect of the birth certificate provided under subsection (1).

2.2The Registrar General may waive payment of a fee prescribed by paragraph 2(j), 2.01(j) or 2.02(j) for compassionate reasons.

3New Brunswick Regulation 83-104 under the Vital Statistics Act is repealed.
4This Regulation comes into force on April 15, 1993.
