REGULATION 2022-30

Aquaculture Act

Under subsection 90(1) of the Aquaculture Act, the Lieutenant-Governor in Council makes the following Regulation:

Citation

1This Regulation may be cited as the Aquaculture Products Health and Welfare Regulation – Aquaculture Act.

Definitions

2The following definitions apply in this Regulation.

“Act” means the Aquaculture Act.(Loi)

“failure of containment structures” means the escape of 50 or more finfish from a site. (défaillance des structures de confinement)

“mortality event” means, in relation to a site, unexpected death that qualifies as a mortality event referred to in section 59 of the Act, and more particularly(épisode de mortalité)

(a) in the case of shellfish, mortality exceeds 15% of stock over a 12-month period, or

(b) in the case of finfish, mortality exceeds

(i) 2% of stock over a period of 24 hours, or

(ii) 5% of stock in a period of five days.

Form of report

3A report made under section 56 or 59 of the Act shall be made either directly, on a form provided by the Chief Veterinary Officer, or indirectly, through a third party database.

Reporting failure of containment structures

4For the purposes of section 56 of the Act, the reporting of a failure of containment structures at a site shall be made in accordance with the Code of Containment for Finfish Aquaculture in New Brunswick (2nd edition, 2021), published by Atlantic Canada Fish Farmers Association.

Timing of report

5(1)For the purposes of subsection 59(3) of the Act, a report made in respect of a reportable condition shall be delivered as follows:

(a) for those reportable conditions listed in Part 1 of Schedule A – within 24 hours after identification;

(b) for those reportable conditions listed in Part 2 of Schedule A – within 48 hours after identification;

(c) for those reportable conditions listed in Part 3 of Schedule A – within 24 hours after identification and each year after the initial report;

(d) for those reportable conditions listed in Part 4 of Schedule A – within one month after identification; and

(e) for those reportable conditions listed in Part 5 of Schedule A – within one year after identification.

5(2)A report of a mortality event shall be made within 24 hours after identification.

6This Regulation comes into force on July 1, 2022.
