Under subsection 90(1) of the Aquaculture Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Rents and Fees RegulationAquaculture Act.
Definitions
2The following definitions apply in this Regulation.
“Act” means the Aquaculture Act.(Loi)
“inland site” means a site that is situated in non-tidal waters or on land.(site terrestre)
“marine site” means a site that is situated in tidal waters.(site marin)
Designation of aquaculture land
3 For the purposes of subsection 8(2) of the Act, the application fee for a designation of aquaculture land is $500.
Leases
4(1)For the purposes of section 15 of the Act, the application fee for a lease is $2,400.
4(2)For the purposes of section 19 of the Act, the rent for a lease is
(a) $250/hectare for a commercial marine site for finfish, and
(b) for a commercial marine site for shellfish, the greater of
(i) $20/hectare, and
(ii) $200.
4(3)The rent for a lease is payable to the Minister on the date specified in the lease, or, when no date is specified, on or before April 1 of each year.
4(4)For the purposes of subsection 21(2) of the Act, the application fees are
(a) $2,400 for the amendment of a lease,
(b) $450 for the renewal of a lease, and
(c) $575 for the transfer of a lease.
Permits
5(1)For the purposes of section 25 of the Act, the application fee for a permit is $2,400.
5(2)For the purposes of section 29 of the Act, the rent for a permit is
(a) $250/hectare for a commercial marine site for finfish, and
(b) for a commercial marine site for shellfish, the greater of
(i) $20/hectare, and
(ii) $200.
5(3)The rent for a permit is payable to the Minister on the date specified in the permit, or, when no date is specified, on or before April 1 of each year.
5(4)For the purposes of subsection 30(2) of the Act, the application fees are
(a) $2,400 for the amendment of a permit, and
(b) $450 for the renewal of a permit.
Licences
6(1)For the purposes of section 35 of the Act, the application fee for a commercial licence or a scientific licence is
(a) $450 for a marine site, and
(b) $600 for an inland site.
6(2)For the purposes of section 40 of the Act,
(a) the annual licence fee is
(i) $100 for a commercial licence, and
(ii) $100 for a scientific licence, and
(b) the annual licence fee is payable on or before April 1 of each year.
6(3)For the purposes of subsection 42(2) of the Act, the application fees are
(a) $450 for the amendment or renewal of a commercial licence or scientific licence for a marine site,
(b) $600 for the amendment or renewal of a commercial licence or scientific licence for an inland site, and
(c) $250 for the reinstatement of a licence.
Commencement
7This Regulation comes into force on July 1, 2022.
