Restricted Beverages Act
Assented to December 11, 1992
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

Definitions
1In this Act
“restricted beverage” means a beverage obtained by the alcoholic fermentation of an infusion or decoction of barley malt and hops or of any similar products in drinkable water and containing 0.5 per cent or less of proof spirits.(boisson restreinte)
Sale of restricted beverage to minor
2(1)No person shall sell a restricted beverage to a person under the age of nineteen years and no person shall sell a restricted beverage to a person appearing to be under the age of nineteen years without first obtaining proof that such person is of the full age of nineteen years and in any prosecution under this section, the judge shall determine from the appearance of such person and other relevant circumstances whether the person appears to be under the age of nineteen years.
2(2)The provisions of the Liquor Control Act in respect of proof of age apply with the necessary modifications to persons selling a restricted beverage and to persons asking to purchase or purchasing a restricted beverage under this section.
Offences
3A person who violates or fails to comply with subsection 2(1) commits an offence punishable under Part II of the Provincial Offences Procedure Act as a category B offence.
4This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
