National Parks Act

Definitions
1In this Act
“historic site” means an area of historic significance situated on public land or land acquired under this Act for transfer to Canada for development as a national historic park under the National Parks Act, chapter N-13 of the Revised Statutes of Canada, 1970;(lieu historique)
“Minister” means the Minister of Natural Resources;(Ministre)
“national park” means an area of public land or land acquired under this Act for transfer to Canada for use as a national park under the National Parks Act, chapter N-13 of the Revised Statutes of Canada, 1970;(parc national)
“public land” means ungranted or reconveyed lands, whether or not any water flows over or covers the same, which belong to Her Majesty in right of the Province.(terres publiques)

Administration
2The Minister shall administer this Act.

Power of Cabinet to acquire land
3The Lieutenant-Governor in Council, on the recommendation of the Minister, may acquire by gift, purchase or expropriation land that is considered suitable by the National and Historic Parks Branch of the Department of Indian Affairs and Northern Development (Canada) for development as a national park or historic site.

Expropriation of land
4A land area suitable for development as a site for a national park or historic site is deemed to be a work or enterprise in the public interest within the meaning of the Expropriation Act.

Conveyance of land to Canada
5(1)The Minister, with the approval of the Lieutenant-Governor in Council, may transfer the administration and control of public land and lands acquired under this Act to Canada for the purposes of establishing a national park or historic site.
5(2)A transfer of administration and control under subsection (1) includes all mines, minerals, oil and natural gas lying on or under the lands transferred.

Conveyance of land to Canada
6Subject to any claim for compensation under the Expropriation Act, all rights, privileges, powers, obligations or liabilities acquired, accrued, accruing or incurred are cancelled in so far as they affect lands lying within the area conveyed under section 5.

Agreements with Canada
7The Minister, with the approval of the Lieutenant-Governor in Council, may enter into an agreement with Canada setting forth the terms and conditions under which a national park or historic site is to be established.
