Right to payment
1(1)The Workplace Health, Safety and Compensation Commission shall make a monthly payment to a workman or his widow at the rate prescribed by regulation if, in the opinion of the Workplace Health, Safety and Compensation Commission, the workman
(a)
is or becomes disabled and cannot continue his ordinary occupation because he contracted silicosis in the course of his employment in New Brunswick before June 1, 1948, or
(b)
dies or has died after June 1, 1948 because he contracted silicosis in the course of his employment in New Brunswick before June 1, 1948.
1(2)When a workman to whom payment has been awarded under this Act dies or has died, payment at the rate prescribed by regulation shall be made to his widow during her lifetime or until she remarries.
1(3)If a widow remarries, payment at the rate prescribed by regulation shall cease but she shall be entitled in place of that payment to a sum equal to one year’s payments.
