Preamble
WHEREAS the Provinces of New Brunswick, Nova Scotia and Prince Edward Island are unanimous in their desire to promote unity of purpose among their respective governments; and
WHEREAS they wish to ensure maximum coordination of the activities of the governments of the three provinces and their agencies; and
WHEREAS these provinces wish to establish the framework for joint action and undertakings; and
WHEREAS the Maritime Union Study recommended the establishment of a Council of Maritime Premiers as one of the agencies for cooperative action among these provinces; and
WHEREAS by an agreement dated May 25, 1971, the Premiers of these provinces agreed to general principles for the operation of a Council of Maritime Premiers for the purpose of pursuing the objectives recited in this preamble; and
WHEREAS the Premiers have met several times for that purpose; and
WHEREAS it is desirable to enact legislation in each of these provinces respecting a Council of Maritime Premiers;
THEREFORE, Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Definitions
1The following definitions apply in this Act.
“agreement” means an agreement among the Provinces of New Brunswick, Nova Scotia and Prince Edward Island referred to in section 2. (accord)
“Council” means the Council of Maritime Premiers established under this Act. (Conseil)
“parties” means the Crown in right of each of the Provinces of New Brunswick, Nova Scotia and Prince Edward Island represented by their respective Lieutenant-Governors in Council. (parties)

Power of Lieutenant-Governor in Council to enter agreement
2The Lieutenant-Governor in Council may
(a) enter into an agreement with the Provinces of Nova Scotia and Prince Edward Island for the establishment of a Council of Maritime Premiers comprised of the Premiers of the Provinces of New Brunswick, Nova Scotia and Prince Edward Island, and
(b) agree with the Provinces of Nova Scotia and Prince Edward Island to amend the agreement.

Contents of agreement
3The agreement may
(a) authorize the Council to do or cause to be done, on behalf of the parties, any or all of those things that the parties to it are otherwise empowered to do and consider necessary for or ancillary to the attainment of the objectives set out in the preamble to this Act,
(b) provide for the financing of the operations of the Council and for cost-sharing arrangements, and
(c) contain any other provision that may be necessary or desirable to provide for the administration of the Council and for its operations.

Fiscal year of Council
4The fiscal year of the Council commences on April 1 in each year and ends on March 31 in the next year.

Annual budget of Council
5The Council shall prepare an annual budget that shall be submitted to the Lieutenant-Governor in Council.

Appropriations by provinces
6If the budget is approved by the Lieutenant-Governors in Council in the Provinces of New Brunswick, Nova Scotia and Prince Edward Island, there shall be introduced in the Legislature a resolution for an appropriation to enable the Province to meet its share of the budget.

Annual report of Council
7Each year the Council shall prepare and publish a report on its activities in the preceding year.

Agreement to be tabled
8An agreement or an amendment to it made under this Act when the Legislature is in session shall be tabled during that session or, if it is not in session, shall be tabled at the next following session.

Status of agreement of May, 1971
9The agreement dated May 25, 1971, shall be deemed to be an agreement under this Act.
