Under section 261 of the Motor Vehicle Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Special Permit Fees Regulation - Motor Vehicle Act.
Definitions
2In this Regulation
“Act” means the Motor Vehicle Act;(Loi)
“regulations” means regulations under the Motor Vehicle Act;(règlements)
“special permit” means a special permit issued by the Minister of Transportation and Infrastructure under section 261 of the Act for a vehicle or combination of vehicles, with or without load.(autorisation spéciale)
“special permit for forest roads” means a special permit issued or renewed by the Minister of Natural Resources under section 261.1 of the Act for a vehicle or combination of vehicles, with or without load.(autorisation spéciale pour les chemins de forêt)

Special permit for forest roads – fee
2.1(1)For the purposes of section 261.1 of the Act, the fee for the issuance or renewal of a special permit for forest roads is $1,101.
2.1(2)The fee referred to in subsection (1) shall be paid before or at the time of issuance or renewal of the special permit for forest roads.

Period not exceeding 7 days, exceeding maximum size – fee
3Where the Minister of Transportation and Infrastructure issues a special permit for a period of time that does not exceed 7 days for a vehicle or combination of vehicles, including any load thereon, that exceed the maximum size specified in the regulations, the fee shall be as follows:
(a) where the maximum length is exceeded – $55;
(b) where the maximum height is exceeded – $55; and
(c) where the maximum width is exceeded and the width
(i) does not exceed 3.65 metres – $55,
(ii) exceeds 3.65 metres but does not exceed 4.12 metres – $55,
(iii) exceeds 4.12 metres but does not exceed 4.72 metres – $55, or
(iv) exceeds 4.72 metres – $95.

Interpretation of section 3
3.1(1)For the period commencing on December 1, 2023, and ending on November 30, 2024,
(a) the reference to “$55” in paragraphs 3(a) and (b) and subparagraphs 3(c)(i), (ii) and (iii) shall be read as a reference to “$60”, and
(b) the reference to “$95” in subparagraph 3(c)(iv) shall be read as a reference to “$103”.
3.1(2)On and after December 1, 2024,
(a) the reference to “$55” in paragraphs 3(a) and (b) and subparagraphs 3(c)(i), (ii) and (iii) shall be read as a reference to “$65”, and
(b) the reference to “$95” in subparagraph 3(c)(iv) shall be read as a reference to “$112”.

Period not exceeding 7 days, exceeding maximum gross mass – fee
4Where the Minister of Transportation and Infrastructure issues a special permit for a period of time that does not exceed 7 days for a vehicle or combination of vehicles that exceed the maximum gross mass specified in the regulations for that vehicle or combination of vehicles, the fee shall be as follows:
(a) in the case of a three axle vehicle or combination of vehicles, where the maximum gross mass is exceeded and the gross mass
(i) does not exceed 30,500 kg – $55,
(ii) exceeds 30,500 kg but does not exceed 33,000 kg – $56,
(iii) exceeds 33,000 kg but does not exceed 35,500 kg – $75, or
(iv) exceeds 35,500 kg but does not exceed 38,000 kg – $95;
(b) in the case of a four axle vehicle or combination of vehicles, where the maximum gross mass is exceeded and the gross mass
(i) does not exceed 40,500 kg – $55,
(ii) exceeds 40,500 kg but does not exceed 43,000 kg – $56,
(iii) exceeds 43,000 kg but does not exceed 45,500 kg – $75, or
(iv) exceeds 45,500 kg but does not exceed 48,000 kg – $95;
(c) in the case of a five axle vehicle or combination of vehicles, where the maximum gross mass is exceeded and the gross mass
(i) does not exceed 48,500 kg – $55,
(ii) exceeds 48,500 kg but does not exceed 51,000 kg – $56,
(iii) exceeds 51,000 kg but does not exceed 53,500 kg – $75, or
(iv) exceeds 53,500 kg but does not exceed 56,000 kg – $95;
(d) in the case of a six axle vehicle or combination of vehicles, where the maximum gross mass is exceeded and the gross mass
(i) does not exceed 51,500 kg – $55,
(ii) exceeds 51,500 kg but does not exceed 54,000 kg – $56,
(iii) exceeds 54,000 kg but does not exceed 56,500 kg – $75,
(iv) exceeds 56,500 kg but does not exceed 59,000 kg – $95,
(v) exceeds 59,000 kg but does not exceed 64,000 kg – $142, or
(vi) exceeds 64,000 kg but does not exceed 72,000 kg – $373, or
(vii) exceeds 72,000 kg – $550;
(e) in the case of a seven axle vehicle or combination of vehicles, where the maximum gross mass is exceeded and the gross mass
(i) does not exceed 53,500 kg – $55,
(ii) exceeds 53,500 kg but does not exceed 56,000 kg – $56,
(iii) exceeds 56,000 kg but does not exceed 58,500 kg – $75,
(iv) exceeds 58,500 kg but does not exceed 61,000 kg – $95,
(v) exceeds 61,000 kg but does not exceed 64,000 kg – $142,
(vi) exceeds 64,000 kg but does not exceed 72,000 kg – $373, or
(vii) exceeds 72,000 kg – $550; and
(f) in the case of a vehicle or combination of vehicles with eight or more axles, where the maximum gross mass is exceeded and the gross mass
(i) does not exceed 64,000 kg – $55,
(ii) exceeds 64,000 kg but does not exceed 72,000 kg – $373, or
(iii) exceeds 72,000 kg – $550.

Interpretation of section 4
4.1(1)For the period commencing on December 1, 2023, and ending on November 30, 2024,
(a) the reference to “$55” in subparagraphs 4(a)(i), (b)(i), (c)(i), (d)(i), (e)(i) and (f)(i) shall be read as a reference to “$60”,
(b) the reference to “$56” in subparagraphs 4(a)(ii), (b)(ii), (c)(ii), (d)(ii) and (e)(ii) shall be read as a reference to “$61”,
(c) the reference to “$75” in subparagraphs 4(a)(iii), (b)(iii), (c)(iii), (d)(iii) and (e)(iii) shall be read as a reference to “$82”,

Period not exceeding 7 days, exceeding maximum mass but not maximum gross mass – fee
5Where the Minister of Transportation and Infrastructure issues a special permit for a period of time that does not exceed 7 days for a vehicle or combination of vehicles that
(a) exceed the maximum mass for an axle or group of axles for that vehicle or combination of vehicles as specified in the regulations, and
(b) does not exceed the maximum gross mass for that vehicle or combination of vehicles as specified in the regulations,
the fee shall be $55.

Interpretation of section 5
5.1(1)For the period commencing on December 1, 2023, and ending on November 30, 2024, the reference to “$55” in section 5 shall be read as a reference to “$60”.
5.1(2)On and after December 1, 2024, the reference to “$55” in section 5 shall be read as a reference to “$65”.

Period not exceeding 3 months, exceeding maximum size – fee
6If the Minister of Transportation and Infrastructure issues a special permit for a period of time that exceeds 7 days but does not exceed 3 months for a vehicle or combination of vehicles, including any load thereon, that exceed the maximum size specified in the regulations, the fees shall be as follows:
(a) if the maximum length is exceeded and the length does not exceed 30 metres – $56;
(b) if the maximum height is exceeded and the height does not exceed 4.5 metres on such routes as are designated by the Minister of Transportation and Infrastructure – $56; and
(c) if the maximum width is exceeded and
(i) the width does not exceed 4.27 metres – $56,
(ii) in the case of a vehicle moving a mobile home, modular home or mini home, the width of the box of the home does not exceed 4.4 metres and the width at the eaves of the home does not exceed 4.72 metres – $112, or
(iii) in the case of a vehicle moving a fishing boat that is commercially in use, the width of the beam of the boat does not exceed 4.72 metres, on such routes as are designated by the Minister of Transportation and Infrastructure – $112.

Interpretation of section 6
6.1(1)For the period commencing on December 1, 2023, and ending on November 30, 2024,
(a) the reference to “$56” in paragraphs 6(a) and (b) and subparagraph 6(c)(i) shall be read as a reference to “$61”, and
(b) the reference to “$112” in subparagraphs 6(c)(ii) and (iii) shall be read as a reference to “$122”.
6.1(2)On and after December 1, 2024,
(a) the reference to “$56” in paragraphs 6(a) and (b) and subparagraph 6(c)(i) shall be read as a reference to “$66”, and
(b) the reference to “$112” in subparagraphs 6(c)(ii) and (iii) shall be read as a reference to “$133”.

Period not exceeding 3 months, exceeding maximum gross mass – fee
7If the Minister of Transportation and Infrastructure issues a special permit for a period of time that exceeds 7 days but does not exceed 3 months for a vehicle or combination of vehicles that exceed the maximum gross mass specified in the regulations for that vehicle or combination of vehicles, the fee shall be as follows:
(a) if the maximum gross mass is exceeded and the gross mass does not exceed 50,000 kg – $224;
(b) in the case of a vehicle moving construction and industrial equipment, if the maximum gross mass is exceeded and the gross mass does not exceed 59,000 kg, on such routes as are designated by the Minister of Transportation and Infrastructure – $281.

Interpretation of section 7
7.1(1)For the period commencing on December 1, 2023, and ending on November 30, 2024,
(a) the reference to “$224” in paragraph 7(a) shall be read as a reference to “$245”, and
(b) the reference to “$281” in paragraph 7(b) shall be read as a reference to “$306”.
7.1(2)On and after December 1, 2024,
(a) the reference to “$224” in paragraph 7(a) shall be read as a reference to “$265”, and
(b) the reference to “$281” in paragraph 7(b) shall be read as a reference to “$332”.

8If the Minister of Transportation and Infrastructure issues a special permit for a period of time that exceeds 7 days but does not exceed 3 months for a vehicle or combination of vehicles that
(a) exceed the maximum mass for an axle or group of axles for that vehicle or combination of vehicles as specified in the regulations, and
(b) does not exceed the maximum gross mass for that vehicle or combination of vehicles as specified in the regulations,
the fee shall be $112.

8.1(1)For the period commencing on December 1, 2023, and ending on November 30, 2024, the reference to “$112” in section 8 shall be read as a reference to “$122”.
8.1(2)On and after December 1, 2024, the reference to “$112” in section 8 shall be read as a reference to “ $133”.

Period not exceeding 12 months, exceeding maximum size – fee
9If the Minister of Transportation and Infrastructure issues a special permit for a period of time that exceeds 3 months but does not exceed 12 months for a vehicle or combination of vehicles, including any load thereon, that exceed the maximum size specified in the regulations, the fees shall be as follows:
(a) if the maximum length is exceeded and the length does not exceed 30 metres – $187;
(b) if the maximum height is exceeded and the height does not exceed 4.5 metres, on such routes as are designated by the Minister of Transportation and Infrastructure – $187; and
(c) if the maximum width is exceeded and
(i) the width does not exceed 4.27 metres – $187,
(ii) in the case of a vehicle moving a mobile home, modular home or mini home, the width of the box of the home does not exceed 4.4 metres and the width at the eaves of the home does not exceed 4.72 metres – $373, or
(iii) in the case of a vehicle moving a fishing boat that is commercially in use, the width of the beam of the boat does not exceed 4.72 metres, on such routes as are designated by the Minister of Transportation and Infrastructure – $373.

9.1(2)On and after December 1, 2024,

Period not exceeding 12 months, exceeding maximum gross mass – fee
10If the Minister of Transportation and Infrastructure issues a special permit for a period of time that exceeds 3 months but does not exceed 12 months for a vehicle or combination of vehicles that exceeds the maximum gross mass specified in the regulations for that vehicle or combination of vehicles, the fee shall be as follows:
(a) if the maximum gross mass is exceeded and the gross mass does not exceed 50,000 kg – $746;
(b) in the case of a vehicle moving construction and industrial equipment, if the maximum gross mass is exceeded and the gross mass does not exceed 59,000 kg – $932.
(c) in the case of a vehicle or combination of vehicles that exceeds the maximum gross mass specified in Schedule B of New Brunswick Regulation 2001-67 under the Act for that vehicle or combination of vehicles and is otherwise in conformity with that regulation – $55; and
(d) in the case of a vehicle or combination of vehicles that is subject to a compliance monitoring plan approved by the Minister of Transportation and Infrastructure and
(i) exceeds the maximum gross mass specified in Schedule B of New Brunswick Regulation 2001-67 under the Act for that vehicle or combination of vehicles and is otherwise in conformity with that regulation –  $55,
(ii) is not in conformity with the Act or the regulations – $55, or
(iii) exceeds a gross mass of 62,500 kg or the maximum gross mass specified in Schedule A of New Brunswick Regulation 2001-67 under the Act for that vehicle or combination of vehicles – $932.

Interpretation of section 10
10.1(1)For the period commencing on December 1, 2023, and ending on November 30, 2024,
(a) the reference to “$746” in paragraph 10(a) shall be read as a reference to “$814”,

(a) exceed the maximum mass for an axle or group of axles for that vehicle or combination of vehicles as specified in the regulations, and
(b) does not exceed the maximum gross mass for that vehicle or combination of vehicles as specified in the regulations,
the fee shall be $373.

Interpretation of section 11
11.1(1)For the period commencing on December 1, 2023, and ending on November 30, 2024, the reference to “$373” in section 11 shall be read as a reference to “$407”.
11.1(2)On and after December 1, 2024, the reference to “$373” in section 11 shall be read as a reference to “$441”.

Largest of applicable fees
12Notwithstanding any other provision in this Regulation, where a vehicle or combination of vehicles, including any load thereon, exceeds the maximum size specified in the regulations in more than one respect, exceeds the maximum gross mass specified in the regulations for that vehicle or combination of vehicles or exceeds the maximum mass for an axle or group of axles specified in the regulations for that vehicle or combination of vehicles, the fee for a special permit shall be the largest of the applicable fees set out in this Regulation.

Exemption – resident of state of Maine
12.1Notwithstanding any other provision in this Regulation or in New Brunswick Regulation 2001-67 under the Motor Vehicle Act, no fee is payable for a special permit issued under section 261 of the Act for a period of time not exceeding twelve months to a resident of the state of Maine, in respect of a vehicle or a combination of vehicles that
(a) is duly registered in the state of Maine, and
(b) has a gross mass, including any load on the vehicle or combination of vehicles, in excess of forty thousand eight hundred and twenty-four kilograms but not in excess of forty-five thousand three hundred and sixty kilograms.

Vehicle not in conformity
13Where the configuration of a vehicle or combination of vehicles is not in conformity with the Act or the regulations, the fee for a special permit is $55.

Exemption – provincial government
14(1)No fee is payable for a special permit issued in respect of a vehicle or combination of vehicles owned by the provincial government.
14(2)Subsection (1) does not apply to special permits issued in respect of a vehicle or combination of vehicles owned by a Crown corporation.
Duplicate permit – fee
15Where a special permit is lost or misplaced by the holder of the permit, the fee for a duplicate of the special permit is $55.

15.01(1)For the period commencing on December 1, 2023, and ending on November 30, 2024, the reference to “$55” in section 15 shall be read as a reference to “$60”.
15.01(2)On and after December 1, 2024, the reference to “$55” in section 15 shall be read as a reference to “$65”.

Modification of permit – fee
15.1(1)The fee for the modification of a special permit is $55.
15.1(2)Despite subsection (1), no fee is payable for the modification of a special permit as a result of
(a) an error that occurred when processing the request for the special permit or when issuing the special permit, or
(b) an unplanned traffic detour.

15.2(1)For the period commencing on December 1, 2023, and ending on November 30, 2024, the reference to “$55” in subsection 15.1(1) shall be read as a reference to “$60”.
15.2(2)On and after December 1, 2024, the reference to “$55” in subsection 15.1(1) shall be read as a reference to “$65”.

Timing of payment
16The fee for a special permit shall be paid before or at the time of issuance of the special permit.
Commencement
17This Regulation comes into force on July 1, 1989.
