REGULATION 89-106

Under subsection 118(1) of the Fish and Wildlife Act, the Lieutenant-Governor in Council makes the following Regulation:

1This Regulation may be cited as the Posting of Signs on Land Regulation - Fish and Wildlife Act.

2In this Regulation
“Act” means the Fish and Wildlife Act.(Loi)
2004-84
3Signs that are posted on land under section 80 of the Act shall be one of the following:
(a) a red disk or red painted band;
(b) a yellow disk or yellow painted band; or
(c) a placard with printed words.
4(1)A disk referred to in paragraphs 3(a) and (b) shall have a diameter of not less than twenty-five centimetres.
4(2)A painted band referred to in paragraphs 3(a) and (b) shall have a width of not less than twenty-five centimetres and shall encircle a tree or post.
4(3)A sign referred to in paragraph 3(c) shall be of a sufficient size as to be clearly visible and the words shall be legibly printed on the sign.
4.1A disk or a painted band referred to in paragraph 3(b) shall be clearly marked with a unique identification number provided to the owner of the land by the Minister.

5Signs that are posted under section 80 of the Act shall be posted as follows:
(a) at each corner of the land;
(b) at each roadway giving access to the land; and
(c) at intervals along the boundary of the land not exceeding one hundred metres.
6(1)Where the land is posted with signs that are red disks or red painted bands, all shooting, hunting, trapping or snaring is prohibited.
6(2)Where the land is posted with signs that are yellow disks or yellow painted bands, shooting, hunting, trapping or snaring is permitted upon obtaining permission of the owner.
6(3)Where the land is posted with signs referred to in paragraph 3(c), the signs shall indicate clearly the activity or activities that are prohibited by the words “No shooting”, “No hunting”, “No trapping”, “No snaring” or any combination thereof, and such activity or activities are prohibited.

7This Regulation comes into force on August 31, 1989.
