REGULATION 84-76
under the
Surveys Act

Under section 15 of the Surveys Act, the Lieutenant-Governor in Council makes the following Regulation:

1This Regulation may be cited as the General Regulation - Surveys Act.
2In this Regulation
“control point” means a coordinate monument, a previously accepted legal monument, or any semi-permanent point for which coordinates have been determined.(point de repère)

3Pursuant to paragraph 3(2)(b) of the Act, a coordinate monument may be a suitably inscribed brass, bronze or aluminum cap or plate
(a) cemented into bedrock or into a concrete structure, or
(b) secured to the ground by a
(i) twenty-five millimetre square steel bar driven through the center of the cap or plate, or
(ii) galvanized pipe, nineteen millimetres in diameter, to which the cap or plate is attached.

4A surveyor working under section 7 of the Act shall conform to instructions issued by the Director of Surveys.
5A surveyor need not plant legal monuments to mark corners of lots in a subdivision when
(a) at least three control points are in the immediate area of the subdivision;
(b) no corner is further from a control point than
(i) 150 metres for lots 0 to 0.2 hectare in area; or
(ii) 300 metres for lots 0.2 hectares to 4 hectares in area; and
(c) coordinates are computed for each corner.

6(1)When a surveyor requests approval of a plan of survey he shall also submit the following
(a) the original field notes;
(b) computation sheets; and
(c) evidence on which the survey is based.
6(2)When an examination of the plan of survey is completed the Director of Surveys shall file copies of the documents mentioned in subsection (1) and return the originals to the surveyor.
7The Director of Surveys may issue instructions governing the standards of survey and content of subdivision plans.
8Regulation 72-160 under the Surveys Act is repealed.
