REGULATION 84-145
under the
Motor Vehicle Act

Under subsection 248(3) of the Motor Vehicle Act, the Minister makes the following Order:

1This Order may be cited as the Inspection Order - Motor Vehicle Act.
2In this Order
“assigned gross mass” means the gross mass of a trailer or semi-trailer set out in a registration certificate;(masse brute attribuée)
“certificate of inspection” means a certificate indicating the approval of a vehicle inspected by a certified mechanic in accordance with the Vehicle Inspections Regulation - Motor Vehicle Act;(certificat d’inspection)
“configured gross mass” means the total permissible gross mass of a truck or truck tractor plus one trailer, one semi-trailer, two semi-trailers or one semi-trailer and one trailer, set out in a registration certificate;(masse brute ajustée)
“farm truck” means a farm truck as defined in the General Regulation - Motor Vehicle Act;(camion agricole)
“home-made trailer” means a trailer that is declared to be home-made by the owner and that bears no manufacturer’s label, brand or vehicle identification number;(remorque artisanale)
“new vehicle” means a vehicle that has never been registered in any province or territory of Canada, and is sold to its owner by a dealer licensed under section 55 of the Motor Vehicle Act; (véhicule neuf)
“unladen curb mass” means the mass of a vehicle without load;(masse à vide)
“utility trailer” means a trailer, other than a recreational trailer, that has an assigned gross mass of 1499 kilograms or less.(remorque tout usage)

3Subject to sections 3.11 and 4.5, the following vehicles shall bear a valid certificate of inspection and shall be tested at least once within 24 months after the date of issuance of that certificate of inspection:
(a) private passenger vehicles;
(b) family motor coaches, motor vehicles converted to family motor coaches and similar vehicles;
(c) antique vehicles; and
(d) commercial vehicles and farm trucks with an unladen curb mass of 3 000 kg or less.

3.1Despite section 3, the following vehicles that bore a valid certificate of inspection immediately before January 1, 2020, shall be tested at least once within 12 months after the date of issuance of that certificate of inspection:
(a) private passenger vehicles;
(b) family motor coaches, motor vehicles converted to family motor coaches and similar vehicles;
(c) antique vehicles; and
(d) commercial vehicles and farm trucks with an unladen curb mass of 3 000 kg or less.

3.11(1)A private passenger vehicle that is used to provide vehicle-for-hire services shall bear a valid certificate of inspection and shall be tested at least once every 12 months.
3.11(2)Before being used to provide vehicle-for-hire services, a private passenger vehicle that bears a valid certificate of inspection that is valid for more than 12 months shall be tested and shall bear a new certificate of inspection.
3.11(3)Subject to the Act and the regulations under the Act, a private passenger vehicle that bears a valid certificate of inspection that is valid for 12 months or less may be used to provide vehicle-for-hire services until the expiry of the certificate of inspection and, on the expiry of the certificate, subsection (1) applies.

3.2The following vehicles shall bear a valid certificate of inspection and shall be tested at least once within 12 months after the date of issuance of that certificate of inspection:
(a) truck tractors, semi-trailers, trailers and pole trailers with an assigned or configured gross mass of 1 500 kg or more;
(b) commercial vehicles and farm trucks with an unladen curb mass of more than 3 000 kg; and
(c) home-made trailers with an assigned or configured gross mass of 1 500 kg or more.

3.3A home-made trailer with an assigned or configured gross mass of less than 1 500 kg shall bear a valid certificate of inspection and shall be tested before its first registration.

4Commencing January 1, 1985, each of the following vehicles shall bear a valid certificate of inspection and shall be tested at least once every six months thereafter:
(a) Repealed: 84-307

(c) school buses, including conveyances contracted to transport children to and from school;

4.01A taxicab shall bear a valid certificate of inspection and shall be tested at least once every 12 months.

4.011Despite section 4.01, a taxicab that bore a valid certificate of inspection immediately before January 1, 2020, shall be tested at least once within 6 months after the date of issuance of that certificate of inspection.

4.4Commencing January 1, 1989, an authorized emergency vehicle that is a fire department or fire fighting vehicle shall bear a valid certificate of inspection and shall be tested at least once every twelve months thereafter.

4.5(1)On and after January 1, 2020, a vehicle referred to in paragraph 3(a), (b) or (d) that is a new vehicle shall bear a valid certificate of inspection issued before its first registration and shall be tested at least once within 36 months after the date of issuance of that certificate of inspection.
4.5(2)On the expiry of a certificate of inspection referred to in subsection (1), section 3 applies.

6Despite all other provisions of this Regulation, except when a vehicle is transferred to a dealer licensed under section 55 of the Motor Vehicle Act or when a vehicle is not required by the Minister to be tested after its first registration, every vehicle valued at $1,000 or less shall be inspected within 30 days before the transfer of registration of the vehicle, and shall bear a valid certificate of inspection.

7An Order of the Provincial Secretary dealing with Motor Vehicle Inspections and published in The Royal Gazette dated February 18, 1970, and Orders of the Minister of Transportation dealing with Motor Vehicle Inspections and published in The Royal Gazette dated July 16, 1980, and in The Royal Gazette dated February 11, 1981, are rescinded effective January 1, 1985.
