Motor Vehicle Act

Under various sections of the Motor Vehicle Act, the Lieutenant-Governor in Council, or the Minister with the approval of the Lieutenant-Governor in Council, as the case may be, makes the provisions of the following Regulation:
1This Regulation may be cited as the General Regulation - Motor Vehicle Act.
2In this Regulation
“Act” means the Motor Vehicle Act;(loi)
“dangerous articles” Repealed: 89-64
“dealer” means a person who carries on any of the businesses specified in section 54 of the Act and includes salesmen in the employment of a dealer or a dealer’s agent while in the regular service of the dealer acting or purporting to act in the ordinary course of the dealer’s business;(concessionnaire)
“farm truck” means a truck that is owned by a person carrying on a farm business and entitled to use the designation “Registered Professional Agricultural Producer”, “RPAP” or “R.P.A.P.” under section 4 of the Agricultural Producers Registration and Farm Organizations Funding Act and that is used only for transporting (camion agricole)
(a) the truck owner and any other person who is transported free of charge,
(b) tools, machinery, equipment and materials used in agricultural production on a farm, and
(c) animals and animal products, poultry and poultry products, plants and plant products and products of the forest grown or produced on a farm;
“municipality” means a local government as defined in subsection 1(1) of the Local Governance Act and includes a regional service commission within the meaning of the Regional Service Delivery Act.(municipalité)

2.1For the purposes of subsections 3(3.2) and (3.4) of the Act, the Registrar may delegate the powers, authorities, rights, duties or responsibilities under subsection 7(2), section 9, subsection 17.1(3) or 17.2(2), (4), (5), (6) or (7), section 19, subsection 20(1), section 22, 22.1, 23 or 24, subsection 25(1), section 26, subsection 27(1) or (2), paragraph 28(3)(a) or (b), subsection 28(4) or 29(1), section 31, paragraph 32(1)(b), section 36, 37, 38, 40 or 42, subsection 44(1), section 44.1, 51, 52 or 68, paragraph 70(a) or (b), subsection 75(1) or (2), section 76, subsection 78(5), paragraph 79(1)(b), section 81, subsection 82(1), paragraph 82(2)(b), subsection 83(1), 84(2), (7) or (10), 84.11(1) or (7), 85(1) or (3) or 89(2), paragraph 89(5)(c) or (d), subsection 91(1), paragraph 92(2)(a), subsection 93(1), (2) or (3), section 94, subsection 95(1.1), (3), (4) or (5), section 96, subsection 98(1), 193.1(1) or (2) or 259(1) or (2), section 287, subsection 301(1), 309(4) or (11) or 347.1(1) or (3) of the Act, subsection 3(7) or 15(11), section 27.01 or 27.02 of this Regulation or subsection 7(2) or (3) of New Brunswick Regulation 2001-67 under the Motor Vehicle Act to another Minister of the Crown or to the head of a corporation that is an agent of the Province who shall exercise those powers, authorities, duties or responsibilities in accordance with the terms of the delegation.

FEES FOR THE REGISTRATION OF PRIVATE PASSENGER VEHICLES, TAXICABS AND CERTAIN VEHICLES
3(1)Repealed: 91-74
3(1.1)Repealed: 91-74
3(1.2)The annual registration fee for a private passenger vehicle, family motor coach or a motor vehicle converted to a family motor coach shall be based on its unladen curb mass in accordance with Appendix G.
3(2)When a motor vehicle is owned and operated by a municipality, the annual registration fee shall be $19.
3(3)Repealed: 2007-38
3(3.1)When a vehicle is owned and operated by the provincial government or a department thereof, the annual registration fee shall be nil.
3(4)When a motor vehicle is owned and operated by an Amputee, being a person who has lost a limb as a result of his service in the Armed Forces overseas, the annual registration fee shall be $2.00.

3(6)The fee for the vehicle registration for a taxicab shall be the fee prescribed in subsection (1.2).
3(7)The Registrar, upon application therefor, shall register, without payment of the usual annual registration fee, motor vehicles owned by consular officers and trade commissioners who are resident in the Province and who are eligible for inclusion in the booklet entitled “Diplomatic Corps and Consular and Other Representatives in Canada” published by the Department of External Affairs (Canada), November, 1980.

3(9)Where a vehicle registration for a vehicle referred to in this section is a new registration on or after January 1, 1990, the vehicle registration, registration certificate and registration plate shall expire at midnight of the same day one year after the day of the vehicle registration.
3(10)Where a vehicle registration for a vehicle referred to in this section is renewed after April 30, 1990, the vehicle registration, registration certificate and registration plate shall expire at midnight of the same day in each year after the vehicle registration is renewed.
3(11)Notwithstanding subsections (9) and (10), where a vehicle referred to in this section is registered for a period of a number of months that is one month or more and less than twelve months, the vehicle registration, registration certificate and registration plate shall expire at midnight of the last day of the period for which the vehicle registration is issued.
3(12)Notwithstanding subsections (9), (10) and (11), where a vehicle referred to in this section is a commercial vehicle with an unladen curb mass of two thousand two hundred and fifty kilograms or more, the vehicle registration, registration certificate and registration plate shall expire at midnight on March 31 of each year.

ANTIQUE VEHICLES
4(1)When satisfied as to the authenticity of a request to register a motor vehicle as an antique vehicle, the Registrar may so register the vehicle, and issue a special registration plate therefor, for an annual registration fee of $19.
4(1.1)Where a motor vehicle referred to in subsection (1) is a commercial vehicle with an unladen curb mass of two thousand two hundred and fifty kilograms or more, the vehicle registration, registration certificate and registration plate shall expire at midnight on March 31 of each year.
4(2)The owner of a motor vehicle registered as an antique vehicle shall not drive it or permit it to be driven on a highway except
(a) for the purpose of taking the vehicle to be repaired or serviced,
(b) for displaying it to the public in a place, parade or procession and for taking it to and from such a place, parade or procession, or
(c) for driving in an antique vehicle rally.

COMMERCIAL VEHICLES
7(1)Repealed: 91-74

7(1.02)The annual registration fee for a light commercial vehicle shall be based on its unladen curb mass in accordance with Appendix I.

7(1.04)Where a vehicle registration for a light commercial vehicle referred to in subsection (1.02) is a new registration on or after January 1, 1990, the vehicle registration, registration certificate and registration plate shall expire at midnight of the same day one year after the day of the vehicle registration.
7(1.05)Where a vehicle registration for a light commercial vehicle referred to in subsection (1.02) is renewed after April 30, 1990, the vehicle registration, registration certificate and registration plate shall expire at midnight of the same day in each year after the vehicle registration is renewed.
7(1.06)Notwithstanding subsections (1.04) and (1.05), where a light commercial vehicle referred to in subsection (1.02) is registered for a period of a number of months that is one month or more and less than twelve months, the vehicle registration, registration certificate and registration plate shall expire at midnight of the last day of the period for which the vehicle registration is issued.

7(2)Subject to subsections 3(2), (3.1), (4) and (7), 4(1) and 7(3), (4), (5) and (6), the annual registration fee for a commercial vehicle with an unladen curb mass of two thousand two hundred and fifty kilograms or more shall be in accordance with the table and rates prescribed in Appendix E.
7(2.1)The vehicle registration, registration certificate and registration plate for a commercial vehicle referred to in subsections (3), (4), (5) or (6) with an unladen curb mass of two thousand two hundred and fifty kilograms or more shall expire at midnight on March 31 of each year.
7(2.2)Where a commercial vehicle with an unladen curb mass of two thousand two hundred and fifty kilograms or more is registered for a period of months that is one month or more and less than twelve months, the vehicle registration, registration certificate and registration plate shall expire at midnight of the same day of the last day of the period for which the vehicle registration is issued.
7(3)For an asphalt and tar spreader, the annual registration fee shall be $75.
7(4)For a service crane, the annual registration fee shall be $75.
7(5)For a motor hearse, the annual registration fee shall be $75.
7(6)For an item of special mobile equipment used solely for the purpose of transporting and developing power for well drilling machinery, wood cutting, threshing or for like purposes, and to which some part of the equipment is permanently attached, the annual registration fee shall be $75.
7(7)The annual fee for the issuance of a transporter plate shall be based on the gross mass of the motor vehicle in accordance with the commercial vehicle table and rates in subsection (2).
7(8)The annual registration fee under subsection (2) for commercial vehicles, including truck tractors, shall be based on the gross mass thereof, but the minimum gross mass shall be in no case taken as less than twice the unladen curb mass of the vehicle unless this exceeds the maximum allowable for a two axle vehicle or for a three axle vehicle.
7(9)Notwithstanding anything in the Vehicle Dimensions and Mass Regulation - Motor Vehicle Act to the contrary, a two axle truck registered for a gross mass of nine thousand kilograms or more may be operated with a gross mass in excess of that for which it is registered, but not exceeding thirteen thousand five hundred kilograms upon issue to the owner of a special permit, the fee for which shall be fifty-five dollars, authorizing the operation thereof for a period of thirty days from the date of issue of the permit.
7(10)Notwithstanding anything in this Regulation to the contrary, a two axle truck registered for a gross mass of seven thousand five hundred kilograms or more may be operated with a gross mass in excess of that for which it is registered, but not exceeding eleven thousand kilograms upon the issue to the owner of a special permit, the fee for which shall be forty dollars, authorizing the operation thereof for a period of thirty days from the date of issue of the permit.

7(11)A person
(a) who is a non-resident, and
(b) who owns or operates a commercial vehicle which is duly registered in his home province or state,
may apply to the Registrar for a temporary exemption from registration under the Act on the form provided for this purpose by the Registrar.
7(12)The Registrar may, upon application for a temporary exemption from registration under the Act and upon payment of the fee prescribed in subsection (13), direct that a commercial vehicle owned and operated by or on behalf of a non-resident and duly registered in the home province or state of the non-resident be exempted from registration under the Act and may issue a trip permit allowing that commercial vehicle to be operated on the highways of the Province for a period of five consecutive days during the time specified on the permit.
7(13)The fee for trip permits shall be as follows:
(a) for a commercial vehicle
(i) without load.............. $24.00;
(ii) with load.............. $85.00;
(b) for a commercial vehicle that is a truck or truck tractor with a trailer, semi-trailer or trailer and semi-trailer attached in a semi-permanent way for the purpose of transporting goods
(i) without load.............. $24.00;
(ii) with load.............. $169.00.

TRAILERS AND SEMI-TRAILERS
8(1)The annual fees for the registration of trailers and semi-trailers shall be in accordance with the following table and rates:
(a) subject to paragraphs (b), (c), (d) and (e) and subsections (1.1) and (1.2), for trailers and semi-trailers other than mobile homes,

8(1.3)Where a semi-trailer or trailer referred to in subsections (1.1) and (1.2) is registered for one year, two years or three years, the vehicle registration, registration certificate and registration plate shall expire at midnight of the last day of the period for which the vehicle registration is issued.
8(2)Where a trailer, a semi-trailer or a trailer and a semi-trailer is attached to a truck or truck tractor in a semi-permanent way for the purpose of transporting goods, the truck or truck tractor, and the trailer, semi-trailer or trailer and semi-trailer shall be considered as one vehicle and the fee therefor shall be in accordance with the table and rates set out for a commercial vehicle.

TRACTORS
9The annual registration fee for a crawler or caterpillar type of tractor or a farm tractor used for commercial purposes other than farming shall be $55.

BUSES
10(1)Subject to subsections (2), (3), (4) and (5), the annual registration fee for a bus shall be based on its unladen curb mass, doubled, and thence in accordance with the commercial vehicle table and rates in subsection 7(2).
10(2)The annual fees payable for the registration of buses operating under a franchise granted by a municipality or by one or more adjoining municipalities and only within the said municipality or municipalities shall be $19.
10(3)The annual fee for the registration of a church bus, being a passenger bus registered in the name of a religious organization, used for the purpose of conveying persons to and from functions conducted by such religious organization shall be $19.
10(4)The annual fee for the registration of a school bus, being a passenger bus used solely for conveying children to and from school shall be $75.
10(5)The annual fee for the registration of a community service bus, being a passenger bus registered in the name of a bona fide community service organization used without remuneration and solely for the purpose of carrying out the aims and objects of such an organization shall be $75.

FARM TRUCKS
11(1)A person may make application to the Registrar to have a maximum of twelve farm trucks owned by the person registered as farm trucks.
11(2)The annual registration fees payable under subsection (4) or (5) shall be paid in full at the time of application and the registered owner shall not be entitled to any rebate.
11(3)When a truck registered as a farm truck, is to be operated otherwise than as a farm truck, the owner
(a) shall, before so operating the truck, make application to the Registrar to have the truck registered as a commercial vehicle, and
(b) shall pay the difference between the registration fee paid under subsection (4) or (5) and the registration fee payable for commercial vehicles.
11(4)The annual fees payable for the registration of light farm trucks shall be in accordance with the following table and rates:

11(6)The annual registration fee for farm trucks under subsection (5) shall be based on the gross mass thereof, but the minimum gross mass shall in no case be taken as less than twice the unladen curb mass of the farm truck.
11(7)Notwithstanding subsection (6), if twice the unladen curb mass of a farm truck exceeds the gross vehicle mass rating specified by the farm truck’s manufacturer, the minimum gross mass of the farm truck shall be taken as the gross vehicle mass rating specified by the manufacturer.

MISCELLANEOUS VEHICLES
12(1)Circuses, shows and entertainment troupes touring the Province with motor vehicles and trailers shall pay a registration fee of $34 for each such vehicle for any thirty day period or fraction thereof the vehicle is used in the Province during the registration year.
12(2)The certificate of registration for any vehicle registered in accordance with subsection (1) shall show the expiry date of the period for which the registration was issued.

REGISTRATION PLATES
13(1)Subject to subsections (2) and (3), where a registration plate is issued as part of a registration transaction under sections 3 to 11 or subsection 15(1), the fee for such registration plate shall be $50.
13(2)Subject to subsection (3), where a personalized registration plate is issued as part of a registration transaction under sections 3 to 11 or subsection 15(1), the fee for such personalized registration plate shall be $175.
13(3)Where a registration plate is issued for a motor vehicle under subsection 3(3.1) or (7), the fee for such plate shall be nil.
13(4)When a special conservation registration plate is issued as part of a registration transaction under sections 3 to 11, the fee payable on the issuance of the registration plate shall consist of
(a) $50 for the issuance of the registration plate, and
(b) $7 to be deposited in accordance with subsection (6).
13(5)After the issuance of a special conservation registration plate, a fee of $7 shall be payable each time
(a) a vehicle to which the registration plate is attached is registered, or
(b) the registration of a vehicle to which the registration plate is attached is renewed.
13(6)The amount of seven dollars payable on issuance of the special conservation registration plate and all subsequent fees of seven dollars payable under subsection (5) shall be deposited into the special purpose account under the Financial Administration Act
(a) that is established as the Wildlife Trust Fund under section 3 of the Wildlife Trust Fund and Wildlife Council Regulation - Fish and Wildlife Act, and is administered by the Minister of Natural Resources and Energy Development or a person designated by that Minister, and
(b) from which money is disbursed for the purposes specified in section 5 of the Wildlife Trust Fund and Wildlife Council Regulation - Fish and Wildlife Act.

TEMPORARY NUMBERS
14(1)Pending the issue of registration plates, the Registrar, in addition to the granting of temporary permits under section 24 of the Act, may, in his discretion, authorize the issuance of temporary numbers by dealers designated by him as dealers authorized to issue temporary numbers.
14(2)Temporary numbers issued pursuant to subsection (1) shall be in a form approved by the Registrar and shall be valid for a period not exceeding fourteen days from the date of issue.

15.01(1)Subject to subsection (2) and for the purposes of section 76 of the Act, the amount the registered owner is entitled to receive as a refund of the registration fee paid by him or her shall be determined by subtracting a processing fee of $25.00 from the amount prorated in relation to the unused months of the registration period.

15.1(1)In this section

15.1(2)A rebuilding record to be provided to the Registrar under paragraph 17.2(6)(a) of the Act for a vehicle shall be on a form provided by the Registrar and shall include
(a) a list of each major part used in rebuilding the vehicle, along with the serial number of each such part, if the part was manufactured with a serial number,
(b) a receipt for each major part used in rebuilding the vehicle, on which shall be set out the serial number of each such part, if the part was manufactured with a serial number, and which shall be signed by the person from whom the part was purchased, and
(c) a certificate of inspection issued by a certified mechanic, certifying that the mechanic has inspected and approved each major part used in rebuilding the vehicle in the manner established for inspection and certification under New Brunswick Regulation 83-185 under the Motor Vehicle Act.
15.1(3)A person who knowingly makes a false or misleading statement or conceals a material fact in any part of a rebuilding record, or in any other documentation or information provided to the Registrar with it, commits an offence punishable under the Provincial Offences Procedure Act as a category H offence.

17(2)In reviewing an application for a dealer’s, sub-dealer’s, used motor vehicle dealer’s or wrecker’s licence, the Registrar shall give consideration to the applicant’s financial standing and business integrity and whether the applicant
(a) has an established place of business;
(b) is engaged primarily in the business of buying, selling and servicing motor vehicles;
(c) is able to conduct properly the business of a motor vehicle dealer;
(d) employs the services of at least one certified mechanic and has proper equipment to repair motor vehicles, or has contracted with a certified mechanic in accordance with subsection (2.1); and

(f) has filed a bond in accordance with section 18 and such other pertinent information consistent with the safeguarding of the public interest.
17(2.1)An applicant referred to in subsection (2) who has contracted with a certified mechanic as described in paragraph (2)(d) shall provide to the Registrar, with the application,
(a) a copy of the contract, which shall provide for a certified mechanic to do all inspections and mechanical work required to be done by the applicant and in which shall be set out
(i) the names, addresses and telephone numbers of the parties to the contract,
(ii) the address and the licence number of the official testing station at which the inspections and mechanical work will be performed, and
(iii) any expiry date of the contract, and
(b) evidence satisfactory to the Registrar that
(i) the quality of service provided to the customer under the contract would be at least reasonably equivalent to the quality of service that would be provided to the customer if the applicant were to employ a certified mechanic, and
(ii) all inspections and mechanical work will be performed at the official testing station referred to in the contract in accordance with all applicable legislation and regulations.
17(2.2)The holder of a licence issued under this section shall notify the Registrar in writing forthwith of any change in the names, addresses, telephone numbers, terms or other material information set out in, or of the expiry or cancellation of, a contract referred to in subsection (2.1).
17(2.3)The Registrar, if satisfied that a contract referred to in subsection (2.1) is no longer subsisting or does not fulfil the requirements of that subsection, may suspend the licence to which it relates and may reinstate a suspended licence upon being satisfied that there is a valid contract conforming to those requirements.
17(2.4)The Registrar may suspend a dealer’s licence where the dealer
(a) no longer has an established place of business,
(b) is no longer engaged primarily in the business of buying, selling and servicing motor vehicles,
(c) is no longer able to conduct properly the business of a motor vehicle dealer, or
(d) has failed to maintain a bond filed in accordance with section 18.
17(2.5)When deciding whether to suspend a dealer’s licence under subsection (2.4), the Registrar shall give consideration to the dealer’s financial standing and business integrity.
17(2.6)The Registrar may, if satisfied that the conditions leading to the suspension have been corrected, reinstate a dealer’s licence suspended under subsection (2.4).
17(3)The fee for a dealer’s, sub-dealer’s, used motor vehicle dealer’s or wrecker’s licence is one hundred and fifty dollars.
17(4)The fee for a renewal of a dealer’s, sub-dealer’s, used motor vehicle dealer’s or wrecker’s licence is seventy-six dollars.

17(6)The Motor Carrier Board is designated as the body to which appeals may be made from any decision of the Registrar in relation to applications for and the issuance, renewal, suspension, cancellation and reinstatement of licences of dealers and wreckers.
17(7)An appeal referred to in subsection (6) shall be in writing, signed by the appellant or the agent of the appellant and delivered to the Secretary of the Motor Carrier Board within thirty days after the receipt by the appellant of the Registrar’s decision.

18(1)The bond required to be furnished to the Registrar by the dealer under section 54 of the Act shall be in the amount of ten thousand dollars.

DRIVER’S LICENCES
22(1)Driver’s licences shall be of the following classes and shall, if issued to an individual, authorize them to operate any of the types of vehicles specified therein and no other:
(a) Class 9 - authorizes a person to drive a motor-driven cycle and a farm tractor;
(b) Class 8 - authorizes a person to drive a farm tractor only;
(c) Class 7 - authorizes a person who is receiving instructions in the operation of a motor vehicle to drive a motor vehicle;
(d) Class 6 - authorizes a person to drive a motorcycle or any of the vehicles described in Class 9;
(e) Class 5 - authorizes a person to drive
(i) any motor vehicle which the holder of a Class 9 licence may operate,
(ii) any two-axled motor vehicle except a private passenger vehicle while providing a vehicle-for-hire service, an ambulance, a taxicab or a bus,
(iii) any three-axled motor home, and
(iv) any three-axled motor vehicle, other than a truck, of a type designed for use in the construction, maintenance and repair of highways, whether or not the vehicle is to be so used,
and to tow a towed vehicle which is registered up to and including four thousand five hundred kilograms gross vehicle mass behind a motor vehicle or motor home referred to in subparagraphs (i) to (iv);
(f) Class 4 - authorizes a person to drive
(i) any motor vehicle which the holder of a Class 5 licence may operate,
(i.1) any private passenger vehicle while providing a vehicle-for-hire service,
(ii) any ambulance,
(iii) any taxicab, and
(iv) any bus with a capacity of less than twenty-five passengers;
(g) Class 3 - authorizes a person to drive
(i) any motor vehicle which the holder of a Class 5 licence may operate,
(ii) any two-axled motor vehicle towing a towed vehicle, the towed vehicle being registered for over four thousand five hundred kilograms gross vehicle mass but not equipped with air brakes,
(iii) any motor vehicle with three or more axles, and
(iv) any motor vehicle with three or more axles, towing a towed vehicle not equipped with air brakes;
(g.1) Class 3/4 - authorizes a person to drive any motor vehicle which the holder of a Class 3 or 4 licence may operate;
(h) Class 2 - authorizes a person to drive
(i) any motor vehicle which the holder of a Class 3, 4 or 5 licence may operate, and
(ii) any bus with a capacity of more than twenty-four passengers;
(i) Class 1 - authorizes a person to drive
(i) any motor vehicle which the holder of a Class 2, 3, 4 or 5 licence may operate,
(ii) any truck tractor,
(iii) any truck tractor towing a semi-trailer,
(iv) any truck tractor towing a semi-trailer and a trailer,
(v) any truck tractor towing a trailer equipped with air brakes, and
(vi) any truck towing a trailer equipped with air brakes.
22(2)An applicant applying for a driver’s licence to operate a motor vehicle described in Classes 1, 2, 3 and 4 must have reached the age of eighteen years.
22(3)A driver’s licence of Class 1, 2, 3, 4 or 5, which was in effect immediately before April 1, 1985, authorizes the individual to whom the licence was issued, for so long as the licence remains valid, to operate any vehicle which the licence, when issued, authorized that individual to operate.
22(4)Notwithstanding subsection (1), the holder of a driver’s licence of Class 2, 3, 4 or 5 is authorized by the licence to drive a type of motor vehicle, other than a motorcycle, that the holder is not otherwise authorized to drive under that class of licence if the driver complies with the following conditions:
(a) the driver shall be accompanied by a licensed driver who is occupying a seat alongside the driver and who is the holder of a valid and subsisting licence, other than a learner’s licence, that authorizes the holder to operate that type of motor vehicle; and
(b) the driver shall have immediate possession of documentation issued by the Registrar, attesting to the fact that the driver has met all of the conditions that the driver would be required to meet under subsection 27(1) in order to hold a class of licence authorizing the driver to drive that type of motor vehicle, other than any conditions waived by the Minister.
22(5)A driver required to have immediate possession of documentation under paragraph (4)(b) shall upon the request of a peace officer forthwith present and deliver it into the peace officer’s hands for examination by the peace officer.

23(1)In addition to a class number, a driver’s licence issued under section 22 may be endorsed with a letter to expand on the types of vehicles that can be driven by the holder of the licence, to establish that the holder of the licence holds a motorcycle learner’s licence, or to better describe the status of the holder of the licence as follows:
(a) A - valid for motorcycle with an engine size exceeding fifty cubic centimetres;
(b) B - valid for school bus;
(c) C - valid for motorcycle with an engine size exceeding fifty cubic centimetres and school bus;
(d) D - valid for motorcycle with engine size exceeding fifty cubic centimetres but not exceeding five hundred and fifty cubic centimetres;

(f) F - qualified to operate vehicles equipped with air brakes;
(g) G - valid for motorcycle with an engine size exceeding fifty cubic centimetres but not exceeding five hundred and fifty cubic centimetres and school bus;
(h) H - a motorcycle learner’s licence valid for motorcycle with an engine size exceeding fifty cubic centimetres but not exceeding five hundred and fifty cubic centimetres; and
(i) I - a motorcycle learner’s licence valid for motorcycle with an engine size exceeding fifty cubic centimetres.
23(2)Drivers requiring endorsement B, C or G must have reached the age of twenty-one years and have had one year’s driving experience.

24The following classes of drivers, if issued a Class 5 driver’s licence, shall not require a licence of a different class to operate types of vehicles which ordinarily may only be operated by the holder of a different class:
(a) any peace officer operating a motor vehicle in the performance of his duty;
(b) any examiner appointed under the Act;
(c) any salesman of motor vehicles operating a motor vehicle for purposes of demonstration; and
(d) a garage mechanic or other person operating a service truck or testing a motor vehicle on the highway or calling for or delivering a motor vehicle before or after repairing or servicing it.
25(1)Any person not previously licensed in the Province or in any other jurisdiction to operate a motor vehicle, other than a motorcycle, shall obtain a learner’s licence as prescribed under paragraph 27.1(1)(a) before operating a motor vehicle, other than a motorcycle, in the Province.
25(2)Any person not previously licensed in the Province or in any other jurisdiction to operate a motorcycle shall obtain a motorcycle learner’s licence as prescribed under paragraph 27.11(a) before operating a motorcycle in the Province.

26A non-resident chauffeur who is at least eighteen years of age and has in his immediate possession a driver’s licence issued to him by his home Province, state or country, may operate a motor vehicle duly registered in his home Province, state or country without obtaining a licence to drive in this Province unless he accepts employment as a chauffeur from a resident of this Province.
27(1)An applicant for the following classes of licence shall meet the following conditions:
(a) an applicant for a Class 1 or Class 2 driver’s licence shall have
(i) no loss of an arm, a hand, the right foot or right leg,
(ii) no impairment of the use of fingers, feet, legs, hands or arms, or other structural defects, limitation of mobility, or co-ordination, to a degree likely to interfere with the safe operation of a motor vehicle.
(iii) no established history or clinical diagnosis of diabetes that requires insulin for control with the exception of mild diabetes that can be stabilized by the use of hypoglycemia drug and diet where control and medical supervision are sufficient to ensure that the ability of such a person to operate a motor vehicle is not significantly impaired,
(iv) no need for the use of any drug which, if taken in the dosage prescribed or otherwise, could impair their ability to operate a motor vehicle,
(v) no established medical evidence of myocardial infarction, angina pectoris, coronary insufficiency or thrombosis,
(vi) no established medical evidence of heart disease including arrhythmia or respiratory dysfunction likely to interfere with the safe operation of a motor vehicle,
(vii) no established medical evidence of the presence of an aortic aneurysm, whether resected or not,
(viii) no indication of hypertension which is accompanied by postural hypotension resulting in giddiness when under treatment,
(ix) no established medical history of loss of consciousness or awareness due to a chronic or recurring condition,
(x) no corrected visual acuity of less than 20/30 in the best eye and worse than 20/50 in the weakest eye,
(xi) no horizontal visual field of less than 120 degrees in each eye as determined by confrontation tests,
(xii) no colour recognition disability as to impair the ability to accurately identify the colours red, green and amber,
(xiii) no evidence of monocular or aphakic condition,
(xiv) Repealed: 2018-37
(xv) no established medical history or diagnosis of a disorder of the musculoskeletal or nervous system which may interfere with the safe operation of a motor vehicle,
(xvi) no clinical diagnosis as an alcoholic or drug addict, unless it is medically determined that such person is no longer alcohol or drug dependent,
(xvii) no established medical evidence of an intractable psychoneurotic disorder, having particular regard for sustained hostile, aggressive, paranoid or suicidal tendencies, and agitated depression, until evaluated, and
(xviii) no other physical or mental impairment, disease or condition which is likely to significantly interfere with the individual’s ability to operate a motor vehicle safely;
(b) an applicant for a Class 1 or Class 2 driver’s licence shall
(i) produce a medical certificate indicating that the applicant has none of the disabilities set out in paragraph (a), and
(ii) undertake to submit to a medical re-examination and to file a report satisfactory to the Registrar on every renewal of the licence;
(c) an applicant for a Class 3 driver’s licence shall
(i) meet the conditions established for an applicant for a Class 1 or 2 driver’s licence, except for subparagraph (a)(v), in which case the established medical evidence of a first occurrence of myocardial infarction or thrombosis is not a contraindication to a Class 3 licence if it is medically determined that a full recovery has been accomplished, however, a second occurrence or recurring angina pectoris shall result in disqualification,
(ii) have a medical examination and file a report satisfactory to the Registrar on their initial application, but no further medical examination or report is required until the age of sixty-five years, unless the need is otherwise indicated by the occurrence of some physical or mental impairment, and
(iii) have a medical re-examination and file a report satisfactory to the Registrar on every renewal of the licence after reaching the age of sixty-five years;
(d) an applicant for a Class 4 or 3/4 driver’s licence
(i) shall meet the conditions established for a Class 1 or 2 driver’s licence except for subparagraph (a)(i), in which case the loss of a hand, arm, foot or leg is not a contraindication to a Class 4 or 3/4 licence if it can be determined by a driver’s examination that the impairment, without the use of compensating equipment, does not interfere with the safe operation of a motor vehicle provided that when a mechanical device is required to compensate for any impairment referred to in this paragraph, a restricted Class 4 or 3/4 licence may be issued to an applicant so equipped; and
(ii) when applying for a Class 4 driver’s licence for the purpose of providing vehicle-for-hire services, shall not have had their driver’s licence revoked or their driving privileges suspended in the five years preceding the date of the application for the licence;
(e) an applicant for a Class 5, 6, 7, 8 or 9 driver’s licence shall have
(i) a corrected visual acuity not less than 20/40 in at least one eye,
(ii) a horizontal visual field of not less than 120 degrees as determined by confrontation tests, and
(iii) no physical or mental impairment, disease or condition which is likely to significantly interfere with the individual’s ability to operate a motor vehicle safely.
27(2)The Minister may waive any of the conditions set out in subsection (1) as they pertain to a particular applicant for any class of licence if
(a) the Minister is satisfied that a hardship would result in an applicant being denied a particular class of licence because of failure to meet the conditions set out in subsection (1), and
(b) the applicant presents evidence satisfactory to the Minister that they have the ability to safely operate the particular type of vehicles which the class of licence for which they have made application would allow the operation thereof.
27(3)The Minister may refer any application pursuant to subsection (2) to a medical review board, and, in addition, may request the applicant to present, either to the Minister or to the medical review board, satisfactory medical opinion evidence as to the applicant’s ability to operate a motor vehicle.

(a) the licensee is temporarily outside the Province at the time the licence is to expire, or

27.1(1)For the purposes of section 84 of the Act, a learner’s licence shall be
(a) a Class 7 licence, or
(b) subject to subsection 80(3) of the Act, a valid and subsisting licence issued to a non-resident in the home province or country of the non-resident that, in the opinion of the Registrar, authorizes the holder to drive a motor vehicle that is not a motorcycle and is not a motor driven cycle, while receiving instructions in the operation of that motor vehicle.
27.1(2)For the purposes of paragraph 84(9)(c) of the Act, the following persons are exempted from the application of paragraph 84(8)(b) of the Act:
(a) persons who hold a valid and subsisting driver’s licence of Class 1, 2, 3, 4, 5 or 6; and
(b) persons who, during the previous five years, have held a class of licence referred to in paragraph (a) that has lapsed or is otherwise no longer valid.

27.11For the purposes of section 84.11 of the Act, a motorcycle learner’s licence shall be
(a) a Class 1, 2, 3, 3/4, 4, 5, 6 or 7 licence endorsed with
(i) the letter “H”, in the case of a motorcycle with an engine size exceeding fifty cubic centimetres but not exceeding five hundred and fifty cubic centimetres, or
(ii) the letter “I”, in the case of a motorcycle with an engine size exceeding fifty cubic centimetres, or
(b) subject to subsection 80(3) of the Act, a valid and subsisting licence issued to a non-resident in the home province or country of the non-resident that, in the opinion of the Registrar, authorizes the holder to drive a motorcycle, while receiving instructions in the operation of the motorcycle.

27.3(1)For the purposes of section 310.001 of the Act, the following tests are approved, as a group, as a standard field sobriety test:
(a) horizontal gaze nystagmus test, in which a peace officer makes a number of observations of each eye of the test subject while the subject’s eyes follow or look at a stimulus that the officer is moving or holding steady;
(b) walk-and-turn test, in which a peace officer requires the test subject to listen to instructions and then to take a specified number of heel-to-toe steps in a straight line, turn and take the same number of heal-to-toe steps back in a straight line, while counting the steps out loud and looking at his or her feet;
(c) one-leg stand test, in which a peace officer requires the test subject to listen to instructions and then to raise the foot of his or her choice and count out loud, while looking at the raised foot for a specified period timed by the peace officer.
27.3(2)A peace officer shall not require a person to go through a standard field sobriety test unless the peace officer is trained in administering the test and assessing a test subject’s performance of the test.

CRITERIA FOR POOR PERFORMANCE

27.31For the purposes of paragraph 310.001(3)(c) of the Act, the criteria to be met for a poor performance on a standard field sobriety test for drugs or a combination of alcohol and drugs are one or more of the following:
(a) for the horizontal gaze nystagmus test under paragraph 27.3(1)(a), if four or more of the following are present:
(i) lack of smooth pursuit with the left eye;
(ii) lack of smooth pursuit with the right eye;
(iii) distinct nystagmus at the maximum deviation of the left eye;
(iv) distinct nystagmus at the maximum deviation of the right eye;
(v) onset of nystagmus in the left eye before 45 degrees;
(vi) onset of nystagmus in the right eye before 45 degrees;
(b) for the walk-and-turn test under paragraph 27.3(1)(b), if two or more of the following are present:
(i) cannot keep balance during instructions;
(ii) begins to walk too soon;
(iii) stops while walking;
(iv) misses heel-to-toe steps;
(v) steps off the straight line;
(vi) uses arms to balance;
(vii) turns improperly;
(viii) takes the wrong number of heel-to-toe steps;
(c) for the one-leg stand test under paragraph 27.3(1)(c), if two or more of the following are present:
(i) sways while foot is raised;
(ii) uses arms for balance while foot is raised;
(iii) hops while foot is raised;
(iv) puts foot down before the time specified.

PROOF OF FINANCIAL RESPONSIBILITY
33(1)Proof of financial responsibility, as required by subsection 275(3) of the Act, may be given in any one of the following forms:
(a) by the filing with the Registrar of Motor Vehicles of a Certificate of Insurance in Form 1 complying with the following requirements:
(i) the Certificate shall contain the written certification of a licensed insurer to the effect that there has been issued by the insurer to the owner of the vehicle for which registration is sought, a motor vehicle liability policy in a form approved by the Superintendent of Insurance for the purpose of this Regulation, which, at the date of the certification, is in full force and effect;
(ii) the Certificate shall designate, by explicit description or by other adequate reference, the motor vehicle to which the policy applies;
(iii) the Certificate shall certify that the policy shall not be cancelled or expire unless ten days prior notice in writing of such cancellation or expiry shall have been given to the Registrar of Motor Vehicles, P. O. Box 6000, Fredericton, New Brunswick, E3B 5H1; and
(iv) the Certificate shall certify that the policy insures such owner in respect of any one accident to the limit of at least one hundred thousand dollars exclusive of interest and costs, against liability to passengers for remuneration for loss or damage resulting from bodily injury to or the death of one or more such passengers or damage to their property or both;
(b) by the filing with the Registrar of Motor Vehicles of a bond, of a duly licensed guarantee insurance or surety company or of a bond with personal sureties, complying with the following requirements:
(i) the bond shall be approved as adequate security hereunder upon application to a Judge of the Court of King’s Bench in a form approved by the Registrar;
(ii) the bond shall not be cancelled or expire except after ten days written notice to the Registrar, but not after the happening of the event occasioning the injury or damage with respect to which the bond is given; and
(iii) the bond shall be in the amount of one hundred thousand dollars in respect of any one accident; or
(c) by the filing with the Registrar of Motor Vehicles of a Certificate of the Minister of Finance and Treasury Board to the effect that the owner of the motor vehicle had deposited with him a sum of money or securities for money approved by him in the amount or value of one hundred thousand dollars.
33(2)The Minister of Finance and Treasury Board may accept any such deposits as are made to him pursuant to paragraph (1) (c) and issue a certificate therefor if such deposit is accompanied by evidence that there are no unsatisfied executions against the depositor registered in the office of the Sheriff for the County or District in which the depositor resides.

34A separate certificate, surety bond or deposit of money or securities shall be furnished for each vehicle registered in the name of the person furnishing the proof of financial responsibility and used for the purpose described in subsection 275(1) of the Act.
35The licence issued in compliance with the requirements of subsection 275(1) of the Act shall be affixed to the right hand top corner of the windshield of the vehicle so licensed.
UNSATISFIED JUDGMENTS
36A person indebted to the Consolidated Fund in respect of an unsatisfied judgment in an amount of not less than one hundred dollars may make application to the Minister on a form provided by the Registrar for the restoration of his motor vehicle privilege or any part thereof where he makes a proposal to make repayment to the Fund in monthly instalments.
37(1)The Minister shall appoint a Committee to consider applications and proposals made pursuant to this section.
37(2)The Committee shall not approve a proposal unless
(a) it proposes a monthly payment of not less than fifteen dollars, and
(b) the amount of the proposed monthly payments is reasonable, in the opinion of the Committee, having regard to the income and worth of the applicant and all other relevant circumstances.
37(3)The Minister may accept a proposal and direct the restoration of the motor vehicle privilege or part thereof as the case may be, where
(a) the Committee has approved the proposal;
(b) the applicant has given proof of financial responsibility as required by Part VI of the Act; and
(c) the applicant has signed the proposal for payment and has paid the first instalment.
37(4)All instalment payments made under this Regulation shall be made in cash or by certified cheque or money order payable to the Minister of Finance and Treasury Board, Province of New Brunswick, and received in the office of the Minister of Public Safety, Fredericton, N.B., not later than the fifth day of each month.

SAFETY HELMETS FOR MOTORCYCLE RIDERS
38A helmet worn by a motorcycle rider shall conform to the requirements of one or more of the following standards:
(a) United States Department of Transportation, Federal Motor Vehicle Safety Standard 218, Motorcycle helmets;
(b) Snell Memorial Foundation M2010, 2010 Standard for Protective Headgear for Use with Motorcycles and Other Motorized Vehicles;
(c) Snell Memorial Foundation M2005, 2005 Standard for Protective Headgear for Use with Motorcycles and Other Motorized Vehicles; and
(d) United Nations Economic Commission for Europe (UNECE), Regulation No. 22, Uniform Provisions Concerning the Approval of Protective Helmets and of Their Visors for Drivers and Passengers of Motor Cycles and Mopeds.

TIRE STANDARDS FOR MOTORCYCLES

40.1(1)For the purpose of subsection 229.1(1) of the Act, the minimum tread depth for a motorcycle tire is at least 1.6 mm (1/16 in.) of tread remaining when measured in any major tread groove on the tire.
40.1(2)The following motorcycle tire conditions are prescribed for the purpose of subsection 229.1(2) of the Act:
(a) any cracks, cuts, scuffs or snags in excess of 2.54 cm (1 in.) that expose body cords in the tread area;
(b) any cracks, cuts, scuffs or snags in the sidewall of the tire to the extent that body cords are damaged or exposed;
(c) any bumps, bulges or lumps indicating separation of the tread, sidewall or bead area;
(d) a noticeable air leak;
(e) tread no longer evident in cupped area;
(f) visible breaks, boots, blowout patches;
(g) a repair consisting of a plug in the tire sidewall; and
(h) any markings indicating that the tire is not for highway use.

41Pursuant to sections 32 and 79 of the Act, the Lieutenant-Governor in Council authorizes the Minister to enter into a reciprocal agreement with the Province of Nova Scotia and the Province of Prince Edward Island in accordance with the provisions of the said sections and he empowers the Minister to sign all necessary documents and to take such other steps as may be necessary or desirable to effect such reciprocal agreement.

MOTOR-DRIVEN CYCLES
45(1)Subject to the provisions of this Regulation, every person driving a motor-driven cycle upon a highway has all the rights and liabilities of, and is subject to all the requirements applicable to, a driver of a motor vehicle in accordance with the Act, except those provisions which by their very nature can have no application.
45(2)Without limiting the generality of subsection (1), every owner of a motor-driven cycle shall make application to the Registrar for the registration of that motor-driven cycle in accordance with section 22 of the Act and thereupon the Registrar shall issue to the owner one registration plate in accordance with section 29 of the Act.
45(3)Without further limiting the generality of subsection (1), every driver of a motor-driven cycle shall make application in accordance with section 85 of the Act for a licence to operate a motor-driven cycle, and, notwithstanding paragraph 81(1)(a) of the Act, the Registrar may issue a licence to operate a motor-driven cycle to any person who is fourteen years of age or over.

46(1)No person shall drive a motor-driven cycle on a highway unless
(a) it weighs fifty-five kilograms or less, and
(b) it is equipped with
(i) wheels having wheel rims twenty-five centimetres or more in diameter;
(ii) a seat or saddle being seventy centimetres above the level surface on which the vehicle stands;
(iii) a motor not capable of propelling the motor-driven cycle at a speed in excess of fifty kilometres per hour;
(iv) at least one and not more than three headlamps displaying white light which shall comply with the requirements and limitations of the Act;
(v) at least one tail lamp which, when lighted, shall emit a red light plainly visible for a distance of one hundred and fifty metres to the rear; and
(vi) an automatic transmission.
46(2)No person driving a motor-driven cycle shall carry or in any way transport another person on that cycle.
46(3)Every person driving a motor-driven cycle upon a highway shall ride as near to the right side of the highway as practical, exercising due care when passing a standing vehicle or one proceeding in the same direction.
46(4)No person driving a motor-driven cycle shall ride abreast another motor-driven cycle except in the act of overtaking and passing.
46(5)No person shall drive a motor-driven cycle unless he is wearing a helmet protection for his head which helmet conforms with the standards prescribed by section 38.

BICYCLE HELMETS

46.1A helmet worn by a person operating or riding a bicycle on a highway shall
(a) have a smooth outer surface, be constructed so that the helmet is capable of absorbing energy on impact and be strongly attached to a strap designed to be fastened under the chin of the wearer, and
(b) be undamaged from use or misuse.

46.2(1)The helmet referred to in section 46.1 shall conform to the requirements of one or more of the following standards:
(a) Canadian Standards Association CAN/CSA-D113.2-M89, Cycling Helmets, as amended from time to time;
(b) Snell Memorial Foundation B-95, 1995 Standard for Protective Headgear for Use with Bicycles, as amended from time to time;
(c) Snell Memorial Foundation B-90, 1990 Standard for Protective Headgear for Use in Bicycling, as amended from time to time;
(d) Snell Memorial Foundation B-90S, 1994 Supplementary Standard for Protective Headgear for Use with Bicycles, as amended from time to time;
(e) American National Standards Institute ANSI Z90.4-1984, American National Standard for Protective Headgear for Bicyclists, as amended from time to time;
(f) American Society for Testing and Materials ASTM F1447-94, Standard Specification for Protective Headgear Used in Bicycling, as amended from time to time; and
(g) Snell Memorial Foundation N-94, 1994 Standard for Protective Headgear: for Use in Non-Motorized Sports.
