Under sections 258 and 260 of the Motor Vehicle Act, the Lieutenant-Governor in Council makes the following Regulation:
1This Regulation may be cited as the Commercial Vehicle Massing Regulation - Motor Vehicle Act.
2In this Regulation
“Act” means the Motor Vehicle Act;(Loi)
“qualified technician” means a person designated by the Minister of Transportation and Infrastructure under paragraph 260(6)(a) of the Act as being qualified to operate an approved massing device.(technicien qualifié)

3(1)Pat Equipment Corporation Model SAW 10C portable wheel load scale, capacity ten thousand kilograms, is designated as an approved portable wheel massing device.
3(2)The following massing devices are designated as approved portable platform massing devices:
(a) Eldec Corporation Model 3031 portable axle load scale, capacity twenty-seven thousand two hundred and sixteen kilograms; and
(b) Lodec, Inc. Model L3080 portable axle load scale, capacity thirty-six thousand two hundred and eighty kilograms.
3(3)The following massing devices are designated as approved stationary vehicle massing devices:
(a) Toledo Model 820, tri-deck full load cell axle massing scale system, capacity forty-five thousand three hundred and fifty-nine kilograms per deck or one hundred thirty-six thousand seventy-eight kilograms total;
(b) Weigh Tronix Model 2012 60T-G, single deck full load cell axle massing scale system, capacity sixty thousand kilograms by ten kilogram increments;
(b.1) Weigh Tronix Model BMS 2512-60T single steel deck full load cell axle massing scale system, capacity sixty thousand kilograms;
(c) Toledo Model 7540 tri-deck full load cell axle massing scale system, capacity forty-five thousand three hundred and fifty-nine kilograms per deck or one hundred and thirty-six thousand seventy-eight kilograms total;
(d) Howe Richardson Model 1310 full capacity beam mechanical axle massing scale, capacity twenty-seven thousand two hundred and sixteen kilograms, with an electronic load cell conversion kit;
(e) Repealed: 96-70
(f) Canadian Scale Model E821003 tri-deck full load cell axle massing scale system, capacity forty-five thousand three hundred and fifty-nine kilograms per deck or one hundred and thirty-six thousand seventy-eight kilograms total;
(g) Canadian Scale Model E18100 full load cell axle massing scale, capacity forty-five thousand three hundred and fifty-nine kilograms;
(h) Canadian Scale Model E(SL)80503 tri-deck full load cell axle massing scale system, capacity forty-five thousand three hundred and fifty-nine kilograms per deck or one hundred and thirty-six thousand seventy-eight kilograms total;
(i) Weigh Tronix Model HDMT 6023-12, single deck full load cell axle massing scale system, capacity sixty thousand kilograms total;
(j) Weigh Tronix Model HDMT 13 23 33 20-12, quad-deck full load cell axle massing scale system, capacity one hundred and fifty thousand kilograms total;
(j.1) Weigh Tronix Model HDMT5-13 23 33 20-12, quad-deck full load cell axle massing scale system, capacity one hundred and fifty thousand kilograms total;
(k) Canadian Scale Model E(SL)80503 single deck full load cell axle massing scale system, capacity forty-five thousand three hundred and fifty-nine kilograms total;
(l) Weigh Tronix Model IMXT-2412 single steel deck full load cell axle massing scale system, capacity thirty-six thousand two hundred and eighty-eight kilograms; and
(m) Weigh Tronix Model IMXT-8010 tri steel deck full load cell axle massing scale system, capacity one hundred and fifty thousand kilograms.

4To mass vehicles and axles by using approved portable wheel massing devices, a qualified technician shall
(a) direct the operator or the person having care or control of the vehicle to stop the vehicle at a location that is within plus or minus two per cent of a level grade in the longitudinal direction of the vehicle,
(b) ensure that each approved portable wheel massing device is properly adjusted to zero reading,
(c) direct the operator or person having care or control of the vehicle to drive the vehicle onto the approved portable wheel massing devices,
(d) mass an axle or axle group of the vehicle,
(e) repeat any of the steps set out in paragraphs (a) to (d) that may be necessary to mass all of the axles or groups of axles of the vehicle, and
(f) add the masses indicated by the approved portable wheel massing devices to determine the total mass of
(i) an axle,
(ii) an axle group, or
(iii) the entire vehicle.

5(1)To mass vehicles and axles by using approved portable platform massing devices, a qualified technician shall

(d) mass an axle or axle group of the vehicle,
(e) repeat any of the steps set out in paragraphs (a) to (d) that may be necessary to mass all of the axles or groups of axles of the vehicle, and
(f) add the masses indicated by the approved portable platform massing devices to determine the total mass of
(i) an axle,
(ii) an axle group, or
(iii) the entire vehicle.
5(2)When determining the mass of a vehicle and its axles by using approved portable platform massing devices, a qualified technician may use in addition to those devices, approved portable wheel massing devices.

6To mass vehicles and axles by using an approved stationary vehicle massing device, a qualified technician shall
(a) direct verbally or through signs or traffic lights the operator or person having care or control of the vehicle to stop the vehicle on the approach to an approved stationary vehicle massing device,
(b) ensure that the approved stationary vehicle massing device is properly adjusted to zero reading,
(c) direct verbally or through signs or traffic lights the operator or person having care or control of the vehicle to drive the vehicle onto the approved stationary vehicle massing device,
(d) mass an axle or axle group of the vehicle,
(e) repeat any of the steps set out in paragraphs (a) to (d) that may be necessary to mass all of the axles or groups of axles of the vehicle, and
(f) add the masses indicated by the approved stationary vehicle massing device to determine the total mass of
(i) an axle,
(ii) an axle group, or
(iii) the entire vehicle.
