REGULATION 83-163

Motor Vehicle Act

Under section 200.1 of the Motor Vehicle Act, the Lieutenant-Governor in Council makes the following Regulation:
1This Regulation may be cited as the Seat Belt Regulation - Motor Vehicle Act.
2The following definitions apply in this Regulation.
“Act” means the Motor Vehicle Act. (Loi)
“Canada Motor Vehicle Safety Standard 213” means Schedule 3, CMVSS 213 - Child Restraint Systems to the Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations made under the Motor Vehicle Safety Act (Canada). (Norme de sécurité des véhicules automobiles du Canada 213)
“Canada Motor Vehicle Safety Standard 213.1” means Schedule 4, CMVSS 213.1 - Infant Restraint Systems to the Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations made under the Motor Vehicle Safety Act (Canada). (Norme de sécurité des véhicules automobiles du Canada 213.1)
“Canada Motor Vehicle Safety Standard 213.2” means Schedule 5, CMVSS 213.2 - Booster Cushions to the Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations made under the Motor Vehicle Safety Act (Canada). (Norme de sécurité des véhicules automobiles du Canada 213.2)
“Canada Motor Vehicle Safety Standard 213.4” means section 213.4 of the Motor Vehicle Safety Regulations made under the Motor Vehicle Safety Act (Canada). (Norme de sécurité des véhicules automobiles du Canada 213.4)

3An employee or agent of the Canada Post Corporation while engaged in rural mail delivery is exempt from the provisions of subsection 200.1(3) of the Act.
4The following persons are exempt from the provisions of subsection 200.1(6) of the Act:
(a) a driver of a taxicab while transporting for hire a passenger under the age of 16 years;
(a.1) a driver of a private passenger vehicle while transporting a passenger under the age of 16 years in the course of providing a vehicle-for-hire service;
(b) a driver of a bus or a school bus while transporting passengers under the age of 16 years in the course of their duties or employment; and
(c) a driver of an authorized emergency vehicle while transporting a passenger under the age of 16 years in the course of their duties or employment.

6A driver of a motor vehicle on a highway shall ensure that a passenger who meets all of the following criteria is occupying and is properly secured in a child seating and restraint system prescribed under section 7:
(a) the passenger is under the age of 9 years;
(b) the passenger weighs less than 36 kg; and
(c) the passenger has a standing height of less than 145 cm.

6.1(1)Despite section 6, a driver of a motor vehicle registered in a jurisdiction other than New Brunswick is exempt from the provisions of paragraph 200.1(6)(b) of the Act with respect to a passenger under the age of 9 years who weighs less than 36 kg and who stands less than 145 cm in height.
6.1(2)Subsection (1) does not apply where the motor vehicle registered in a jurisdiction other than New Brunswick is rented under an agreement made in the Province.

7A child seating and restraint system is a child seating and restraint system for the purposes of paragraph 200.1(6)(b) of the Act if the system meets the following conditions:
(a) the system is used in accordance with the manufacturer’s instructions and specifications as to weight and, where applicable, height of the child;
(b) the system conforms to the following standards under the Motor Vehicle Safety Act (Canada), as the case may be:
(i) Canada Motor Vehicle Safety Standard 213;
(ii) Canada Motor Vehicle Safety Standard 213.1;
(iii) Canada Motor Vehicle Safety Standard 213.2; or
(iv) Canada Motor Vehicle Safety Standard 213.4; and
(c) the system is installed in accordance with and otherwise conforms to the Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations under the Motor Vehicle Safety Act (Canada) or, where applicable, the Motor Vehicle Safety Regulations under the Motor Vehicle Safety Act (Canada).

8This Regulation comes into force on November 1, 1983.
