Under section 14 of the Free Trade Within Canada Act, the Lieutenant-Governor in Council makes the following Regulation:

Citation

1This Regulation may be cited as the General Regulation – Free Trade Within Canada Act.

Definition of “Act”

2In this Regulation, “Act” means the Free Trade Within Canada Act.

Goods and services

3For the purposes of paragraph 14(1)(a) of the Act, the goods or services set out in Column 1 of Schedule A which are sold in accordance with the regulatory measures of the corresponding Canadian jurisdiction set out in column 2 shall satisfy the corresponding regulatory measures set out in column 3 in relation to their sale in New Brunswick.

Sellers

4(1)For the purposes of paragraph 14(1)(b) of the Act, a seller set out in Column 1 of Schedule B who holds certification issued under the law of the corresponding Canadian jurisdiction set out in column 2 shall satisfy the corresponding legislative requirements set out in column 3 in relation to obtaining certification in New Brunswick.

4(2)In addition to the requirements set out in subsection (1), any seller of goods or services referred to in the Act, whether or not they are listed in Schedule B, who holds certification issued under the law of any Canadian jurisdiction shall satisfy the following New Brunswick legislative requirements if they are otherwise required in order to obtain certification in New Brunswick:

(a) the seller shall provide all required information;

(b) the seller shall pay all required certification fees, including any permit or licence fees;

(c) the seller shall provide evidence of any required insurance, bond or other security; and

(d) the seller shall provide the results of any required criminal record check, vulnerable sector check or other similar check.

Interim Orders

5(1)For the purposes of subsection 10(2) and paragraph 14(1)(c) of the Act, an interim order shall comply with the following standards:

(a) the order shall be published in a standard format on the Department of Intergovernmental Affairs website; and

(b) the order shall contain the following information:

(i) the name of the regulatory body that made the order;

(ii) the commencement date and the expiry date of the order;

(iii) the goods, services and sellers, or categories of them, that are the subject of the order;

(iv) the regulatory measures of New Brunswick to be maintained with respect to the sale of goods or services; and

(v) the legislative requirements of New Brunswick to be maintained with respect to obtaining certification.

5(2)The maximum period for which an interim order is valid shall be 180 days.

Commencement

6This Regulation comes into force on July 1, 2026.
