Under section 265.091 of the Motor Vehicle Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Image-Capturing Enforcement Systems Regulation – Motor Vehicle Act.
Definition of “Act”
2For the purposes of this Regulation, “Act” means the Motor Vehicle Act.
Image-capturing enforcement systems
3For the purposes of the definition “image-capturing enforcement system” in section 1 of the Act, the following devices or any combination of the devices are prescribed:
(a) a device positioned near a roadway that is capable of simultaneously photographing or filming a vehicle travelling on the roadway and measuring the speed of the vehicle or determining the movement, direction or location of the vehicle;
(b) a device attached to or positioned near a traffic control device that is capable of simultaneously photographing or filming a vehicle travelling through an intersection and measuring the speed of the vehicle or determining the movement, direction or location of the vehicle;
(c) a device attached to a police vehicle or a trailer or positioned near a roadway that is capable of photographing or filming the registration plate of a vehicle and comparing the plate to a database of registration plates and alerting the peace officer operating the device if the plate is associated with any violation of paragraph 17(1)(a), (b) or (c) of the Act; and
(d) a device attached to or positioned inside a school bus that is capable of simultaneously photographing or filming a vehicle and measuring the speed of the vehicle or determining the movement, direction or location of the vehicle.
Use of image-capturing enforcement systems
4No person other than a police officer or a member of the Royal Canadian Mounted Police, as those terms are defined in the Police Act, acting on behalf of a local authority shall use an image-capturing enforcement system.
Commencement
5This Regulation comes into force on October 1, 2024.
