Pension Plan Sustainability and Transfer Act

Under section 23 of the Pension Plan Sustainability and Transfer Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Transfer of Prescribed Pension Plans Regulation – Pension Plan Sustainability and Transfer Act.
Definitions
2The following definitions apply in this Regulation.
“Act” means the Pension Plan Sustainability and Transfer Act.(Loi)
“CUPE” means the Canadian Union of Public Employees.(SCFP)
“NBANH” means the New Brunswick Association of Nursing Homes Inc. (AFSNB)
“NBU” means the New Brunswick Union of Public and Private Employees. (SNB)

Pension plans
3The following pension plans are prescribed for the purposes of section 3 of the Act:
(a) the Pension Plan for General Labour, Trades and Services Employees of New Brunswick School Districts, established effective March 1, 1974, as amended;
(b) the Pension Plan for Full Time CUPE 2745 Employees of New Brunswick School Districts, established effective March 1, 1974, as amended;
(c) the Pension Plan for General and Service Employees of New Brunswick Nursing Homes, established effective April 1, 1982, and registered with the Superintendent as NB.0447938, as amended;
(d) the Pension Plan for Nursing and Paramedical Employees of New Brunswick Nursing Homes, established effective April 1, 1982, and registered with the Superintendent as NB.0447946, as amended; and
(e) the Pension Plan for Management Employees of New Brunswick Nursing Homes, established effective April 1, 1982, and registered with the Superintendent as NB.0447953, as amended.
Parties to the negotiation of a memorandum of understanding
4The following parties are prescribed for the purposes of section 4 of the Act:
(a) for a memorandum of understanding with respect to the pension plan referred to in paragraph 3(a), the Crown in right of the Province as represented by the Treasury Board and CUPE Local 1253;
(b) for a memorandum of understanding with respect to the pension plan referred to in paragraph 3(b), the Crown in right of the Province as represented by the Treasury Board and CUPE Local 2745;
(c) for the memorandums of understanding with respect to the pension plan referred to in paragraph 3(c), the parties listed in Schedules A and B and the NBANH; and
(d) for the memorandums of understanding with respect to the pension plan referred to in paragraph 3(d), the parties listed in Schedule C and the NBANH.

Pension plans prescribed for the purposes of paragraph 7(a) of the Act
5The pension plans referred to in section 3 are prescribed for the purposes of paragraph 7(a) of the Act.
Time limits
6(1)For the purposes of subsection 6(1) of the Act, the parties shall endeavour to negotiate and enter into a memorandum of understanding with respect to a pension plan referred to in paragraph 3(a), (b), (c) or (d), as the case may be, within 90 days after the commencement of this Regulation.
6(2)For the purposes of subsection 9(1) of the Act, the parties shall endeavour to negotiate and enter into a transfer agreement
(a) with respect to the pension plans referred to in paragraphs 3(a) to (d), within 90 days after the date a memorandum of understanding has been entered into, and
(b) with respect to the pension plan referred to in paragraph 3(e), within 120 days after the commencement of this Regulation.
Commencement
7This Regulation comes into force on February 1, 2024.
