Fair Registration Practices in Regulated Professions Act

Under subsection 14(1) of the Fair Registration Practices in Regulated Professions Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the General Regulation – Fair Registration Practices in Regulated Professions Act.
Definition of “Act”
2In this Regulation, “Act” means the Fair Registration Practices in Regulated Professions Act.
Regulatory bodies
3For the purposes of section 3 of the Act, the regulatory bodies are prescribed in Schedule A.
Registration – internationally educated individuals

4(1)A regulatory body shall ensure that internationally educated individuals are able to submit applications by electronic means to be registered to practise in a regulated profession.
4(2)A regulatory body shall provide internationally educated individuals with information about any Canadian work experience and additional education that is required for an application for registration to be granted to an internationally educated individual, including, if applicable, identifying specific educational courses or programs.
4(3)A regulatory body that receives an application for registration from an internationally educated individual shall,
(a) within 14 days after receiving the application,
(i) give the individual a notice of receipt, and
(ii) advise the individual that the application
(A) is complete, or
(B) is incomplete and identify the missing information, and
(b) within 90 days after confirming that the application is complete, review the application and send the individual a written decision granting or refusing the application for registration.
4(4)If a regulatory body refuses an application for registration under paragraph (3)(b), the regulatory body shall provide reasons for the refusal and, if applicable, any additional information on the requirements for registration.

Eligibility requirements – labour mobility applicants

5(1)The following requirements are prescribed for the purposes of paragraph 8.1(1)(a) of the Act:
(a) there has been no finding of professional misconduct, incompetence or incapacity against the labour mobility applicant in relation to the regulated profession;
(b) the labour mobility applicant is not the subject of any current proceedings dealing with professional misconduct, incompetence or incapacity in relation to the regulated profession; and
(c) if it is required to practise in the regulated profession, the labour mobility applicant holds professional liability insurance or benefits from professional liability coverage or similar protection that is valid in New Brunswick.
5(2)For the purpose of subsection 8.1(7) of the Act, a labour mobility applicant shall include the following documents and information in an application to be registered:
(a) a statement by the labour mobility applicant attesting that the labour mobility applicant
(i) meets the requirements referred to in subsection (1), and
(ii) meets any requirements established by the Minister under paragraph 8.1(1)(b) of the Act;
(b) a statement by the labour mobility applicant attesting to the labour mobility applicant’s proficiency in French or English, or both; and
(c) if required by the regulatory body for registration,
(i) a police record check,
(ii) a vulnerable sector check, and
(iii) a credit check.

Time limits – registration of labour mobility applicants

6(1)A regulatory body shall give a labour mobility applicant a notice of receipt within seven days after receiving the labour mobility applicant’s registration document.
6(2)A labour mobility applicant shall submit an application to be registered to practise in a regulated profession to the regulatory body within 30 days after receiving a notice of receipt referred to in subsection (1).
6(3)A regulatory body shall review an application for registration and confirm the registration or refuse to register the labour mobility applicant within 30 days after receiving the application.

7If a regulatory body determines that a labour mobility applicant does not meet the requirements of subsection 8.1(1) of the Act, the regulatory body shall provide reasons for the refusal.
