Family Law Act

Under subsection 88(1) of the Family Law Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This regulation may be cited as the General Regulation – Family Law Act.
Definition of “Act”
2In this Regulation, “Act” means the Family Law Act.
Certificate as judgment
3A certificate issued under subsection 31(1) of the Act shall be in Form 1.
Notice of relocation
4For the purposes of paragraph 60(2)(d) of the Act, the following information is prescribed:
(a) the name of the person who intends to undertake a relocation and the name of any child who would be relocating, if applicable;
(b) the address of the person’s current place of residence and their current contact information;
(c) the name of any other child in respect of whom the person has parenting time or decision-making responsibility; and
(d) the name of any person who has parenting time, decision-making responsibility or contact under a contact order in respect of any child referred to in paragraph (a) or (c).
Notice – persons with contact
5For the purposes of subsection 66(2) of the Act, the following information is prescribed:
(a) the name of the person who has contact with a child under a contact order;
(b) the address of the person’s current place of residence and their current contact information;
(c) the name of any child specified in the contact order; and
(d) the name of any person who has parenting time or decision-making responsibility in respect of any child specified in the contact order.
Agreement filed with the Court
6(1)An agreement filed under subsection 79(1) of the Act shall
(a) be in writing,
(b) be signed by the parties to be bound,
(c) be witnessed,
(d) state the name of the person to whom payment is to be made,
(e) state the payment due under the agreement, and
(f) state when and how payments are to be made.
6(2)The filing of an agreement under subsection 79(1) of the Act shall be effected by filing the original or a duplicate original of the agreement.
Commencement
7This Regulation comes into force on March 1, 2021.
