Under section 19 of the Marshland Infrastructure Maintenance Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the General Regulation - Marshland Infrastructure Maintenance Act.
Definition of “Act”
2In this Regulation, “Act” means the Marshland Infrastructure Maintenance Act.
Notice to owner or occupier of private property
3(1)For the purposes of section 5 of the Act, a notice shall
(a) be signed by the Minister,
(b) contain a description of the proposed work to be undertaken,
(c) set out the purpose of the work,
(d) indicate the proposed time frame for carrying out the work,
(e) indicate any heavy equipment that may be used, and
(f) contain the name, address, telephone number and e-mail address of the person employed in the Department of Transportation and Infrastructure who may be contacted respecting the notice.
3(2)A notice referred to in subsection (1) shall be provided to the owner or occupier of private property at least 14 days before any work commences
(a) by delivering it to the owner or occupier, or
(b) by registered mail sent to the last known address of the owner or occupier.
3(3)A notice sent by registered mail shall be deemed to have been received by the person to whom it was addressed four days after the day of mailing.

Circumstances when notice not required
4For the purposes of section 5 of the Act, the Minister is not required to provide notice to the owner or occupier of private property when he or she enters on or passes through private property for the purpose of maintenance work or an inspection or in an emergency.
Commencement
5This Regulation comes into force on February 1, 2014.
