Under section 99 of the
Midwifery Act
, with the approval of the Lieutenant-Governor in Council, the Council makes the following Regulation:
Citation

This Regulation may be cited as the
General Regulation -
Midwifery Act
.
Definition of “Act”
2
In this Regulation “Act” means the
Midwifery Act
.
Application for registration

(1)
Subject to subsection (3), the holder of a baccalaureate degree under paragraph 21(
a
) of the Act must meet the following requirements in order to be entered on the active practice register for midwives:
(
a
)
have successfully passed the Canadian Midwifery Registration Exam;
(
b
)
hold a certification approved by the Council in neonatal resuscitation issued during the previous year;
(
c
)
hold a certification approved by the Council in obstetrical emergency skills issued during the previous 2 years;
(
d
)
hold a certification approved by the Council in cardiopulmonary resuscitation issued during the previous 2 years;
(
e
)
be proficient in English or French;
(
f
)
hold a Certified Criminal Record Verification issued during the previous 3 months;
(
g
)
pay the registration fee;
(
h
)
be legally entitled to work in Canada; and
(
i
)
meet any other requirements established by the Council.

(2)
Subject to subsection (3), a person possessing the educational qualifications under paragraph 21(
b
) of the Act must meet the following requirements in order to be entered on the active practice register for midwives:
(
a
)
have successfully completed a competency assessment program or a bridging program approved by the Council during the previous 2 years;
(
b
)
have successfully passed the Canadian Midwifery Registration Exam;
(
c
)
be proficient in English or French;
(
d
)
hold a Certified Criminal Record Verification issued during the previous 3 months;
(
e
)
pay the registration fee;
(
f
)
be legally entitled to work in Canada; and
(
g
)
meet any other requirements established by the Council.

(3)
A person practising midwifery in another jurisdiction must meet the following requirements in order to be entered on the active practice register for midwives:
(
a
)
be registered as a midwife on the register of another province or territory in Canada during the previous 5 years;
(
b
)
be proficient in English or French;
(
c
)
hold a Certified Criminal Record Verification issued during the previous 3 months;
(
d
)
provide a certificate of standing issued during the previous month;
(
e
)
pay the registration fee;
(
f
)
be without restrictions imposed on their certificate of registration from any other jurisdiction;
(
g
)
be legally entitled to work in Canada; and
(
h
)
meet any other requirements established by the Council.
Information to be recorded on the register

(1)
The Registrar shall record the following information on the register for every midwife:
(
a
)
the name of a midwife, the midwife’s home and workplace address as well as the midwife’s home and workplace telephone number;
(
b
)
the name and address of the academic institution the midwife attended;
(
c
)
the date on which the midwife was first registered;
(
d
)
the restrictions imposed on a midwife’s certificate of registration and the date the restrictions were imposed or withdrawn;
(
e
)
the date of suspension or revocation of a midwife’s registration; and
(
f
)
the expiration date of a midwife’s certificate of registration.

(2)
A midwife shall inform the Registrar of any changes to the information required under paragraph (
a
) within 14 days of the change.
Temporary register

A person can be entered on the temporary register for a maximum of 2 years.
Practice of midwifery

(1)
A midwife may provide the health care services listed in Schedule A.

(2)
A midwife who has additional training as approved by the Council, may provide the health care services listed in Schedule B.
Notes

A midwife shall note on the clinical record of each patient all instances of the following:
(
a
)
any consultations;
(
b
)
any referrals; and
(
c
)
any transfers.
Professional liability insurance

A midwife shall carry professional liability insurance with a discovery clause of not less than $5,000,000 per occurrence or $10,000,000 per year issued by a company licensed to carry on business in the province.
Therapeutics committee

(1)
A therapeutics committee is established consisting of the following 5 members appointed by the Council:
(
a
)
two persons who are registered as midwives in a province or territory of Canada;
(
b
)
one person who is a member of the College of Physicians and Surgeons of New Brunswick who practises family medicine;
(
c
)
one person who is a member of the College of Physicians and Surgeons of New Brunswick who practises obstetrical medicine; and
(
d
)
one person who is a member of the New Brunswick College of Pharmacists.

(2)
The therapeutics committee makes recommendations on the following subjects:
(
a
)
the classification of drugs, blood products and vaccines a midwife may prescribe and administer; and
(
b
)
the screening and diagnostic tests a midwife may order and interpret.

(3)
Each member of the therapeutics committee shall serve a term not exceeding 3 years.

(4)
A member of the therapeutics committee is eligible for reappointment but no person may serve more than 3 consecutive terms on the therapeutics committee.

(5)
After 3 consecutive terms, a member of the therapeutics committee is eligible for reappointment only after a break of one year.

(6)
The therapeutics committee shall meet at least once per year.

(7)
The majority of the members of the therapeutics committee, including a midwife, a member of the College of Physicians and Surgeons of New Brunswick and a member of the New Brunswick College of Pharmacists, constitutes a quorum.

(8)
The recommendations of the therapeutics committee are made by consensus.

(9)
The recommendations of the therapeutics committee can only be implemented after the approval of the Council and the Minister.
