Under section 123 of the Elections Act, the Lieutenant-Governor in Council makes the following Regulation:

Citation

1This Regulation may be cited as the Tariff of Fees Regulation - Elections Act.

Definition of “Act”

2In this Regulation, “Act” means the Elections Act.

Fees for election officers

3(1)The following are the fees applicable for the payment of election officers and others employed with respect to an election:

(a) for a returning officer, for all services rendered in connection with an election, including attending a training session or a recount, $30 per hour;

(b) for an election clerk, for all services rendered in connection with an election, including attending a training session or a recount, $25 per hour;

(c) for a training officer, for all services rendered in preparation for and for the conduct of training sessions for poll officials and for attending a training session, $25 per hour;

(d) for a poll supervisor

(i) for all services rendered on an ordinary or an advance polling day, $225 per day, and

(ii) for attending the training sessions required of poll supervisors, $70;

(e) for a poll official appointed under subsection 61(1) of the Act, other than a poll supervisor,

(i) for all services rendered on an ordinary or an advance polling day, $15 per hour, to a maximum of $150 per day,

(ii) for being on standby to work on an ordinary or an advance polling day, $15 per hour, to a maximum of $150 per day, and

(iii) for attending all required training sessions, $35;

(f) for a special voting officer, for all services rendered in connection with an election, $15 per hour; and

(g) for any other casual employee employed in the office of a returning officer, including a secretary-receptionist, a data entry clerk, a revision officer or a technical support officer, $15 per hour.

3(2)If a person is appointed to fulfil the duties of more than one poll official on the same polling day, the person shall be paid for only one appointment, and if there is a different rate applicable to each appointment, the person shall be paid at the higher rate.

Travel expenses of election officers

4(1)In this section,“election officer” does not include the Chief Electoral Officer or an Assistant Electoral Officer.(membre du personnel électoral)

4(2)Subject to subsections (3) and (4), an election officer shall be reimbursed for travel expenses incurred in the performance of his or her duties in accordance with the Travel Directive issued by the Treasury Board.

4(3)An election officer other than a returning officer shall be reimbursed for travel expenses only if the election officer has been authorized to travel by a returning officer.

4(4)A returning officer shall be reimbursed for travel expenses only if the returning officer has been authorized to travel by the Chief Electoral Officer.

Rental fees

5The following are the rental fees payable with respect to an election:

(a) for the rental of an office to be used by a returning officer for an election in an electoral district, the amount actually and reasonably incurred, as supported by original receipts or invoices;

(b) for the use of a building or a part of a building as a polling station, including heat, lights and cleaning services,

(i) on an ordinary polling day, the greater of $250 and $120 per polling division assigned to that polling station,

(ii) for an advance poll at which there are vote tabulation machines, $350 per machine located at the polling station per day,

(iii) for an advance poll at which there are no vote tabulation machines, $350 per day;

(c) for an additional poll held at a treatment centre, including heat, lights, cleaning services and the attendance of a staff member of the centre, $85 per polling station;

(d) for an additional poll held at any other location, the amount actually and reasonably incurred, as supported by an original invoice or receipt.

Printing costs

6(1)Subject to subsection (2), the amount payable for necessary printing ordered by the Chief Electoral Officer or a returning officer shall be the amount actually and reasonably incurred.

6(2)A statement of account for printing costs shall be prepared by the printer and shall be accompanied by a sample of the work done and, when applicable, approved by the returning officer.

Miscellaneous expenses

7The amount payable for any of the following expenses incurred with respect to an election shall be the amount actually and reasonably incurred, as supported by an original invoice or receipt:

(a) stationery;

(b) postage;

(d) the purchase or rental of computers and other election-related equipment;

(e) software and associated license fees and service charges;

(f) the rental of office furniture;

(g) the installation, provision and maintenance of telecommunication devices and services;

(h) long distance telephone calls;

(i) the cartage of election supplies and materials;

(j) the rental of space for conducting training sessions for poll officials; and

(k) other incidentals necessary for the conduct of the election.

Advisory committee attendance allowance

8The attendance allowance payable to a member of the advisory committee for attending a meeting of the committee is $250 per day.
