Under subsection 265.8(1) of the Motor Vehicle Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Commercial Vehicle Drivers Hours of Service Regulation - Motor Vehicle Act.
Definitions
2The following definitions apply in this Regulation.
“Federal Regulation” means the Commercial Vehicle Drivers Hours of Service Regulations under the Motor Vehicle Transport Act (Canada). (règlement fédéral)
“recreational vehicle” means a commercial vehicle that is(véhicule de plaisance)
(a) designed as mobile accommodation and includes a cabin trailer, collapsible cabin trailer, tent trailer and self-propelled mobile accommodation; or
(b) used to transport recreational equipment such as snowmobiles, watercrafts, fishing and hunting equipment, motorcycles, bicycles and other similar recreational items where that transportation is not in connection with any business, employment or commercial enterprise.
Adoption of Federal Regulation
3The Federal Regulation is adopted, as amended from time to time.
Interpretation of Federal Regulation
4(1)For the purposes of the interpretation and application of the Federal Regulation, as adopted under section 3, the Federal Regulation shall be read with such modifications as the circumstances require, including, without limiting the generality of the foregoing, the modifications provided for in subsections (2) to (4).
4(2)The definition “commercial vehicle” in section 1 of the Federal Regulation and sections 37 to 54 of the Federal Regulation, as adopted under section 3, are not applicable.
4(3)The definition “day” in section 1 of the Federal Regulation, as adopted under section 3, shall be read as “24-hour period”.
4(4)The definition “driver” in section 1 of the Federal Regulation, as adopted under section 3, shall be read as “operator”.
Application
5In addition to the commercial vehicles referred to in subsection 2(1) of the Federal Regulation, as adopted under section 3, the following commercial vehicles are exempted from the application of the Federal Regulation:
(a) a recreational vehicle;
(b) a commercial vehicle fitted with snow removal equipment that is being used in a snow removal operation;
(c) a school bus; and
(d) a private or public utility corporation vehicle that is being used for emergency repairs.

Repeal
6New Brunswick Regulation 89-147 under the Motor Vehicle Act is repealed.
Commencement
7This Regulation comes into force on June 30, 2007.
