Under section 9 of the Employment Standards Act, the Lieutenant-Governor in Council makes the following Regulation:

Citation

1This Regulation may be cited as the Minimum Wage for Categories of Employees in Crown Construction Work Regulation - Employment Standards Act.

Definitions

2The following definitions apply in this Regulation.

“building construction” includes the construction, remodelling and repair of buildings and related work at the same site. (construction de bâtiments)

“road and bridge construction” includes the construction of roads, bridges, sidewalks, parking lots, culverts and drainage and other related work at the same site. (construction de routes et de ponts)

Application

3Notwithstanding the provisions of the Minimum Wage Regulation - Employment Standards Act, this Regulation applies to the categories of employees referred to in sections 4 and 5 when employees in those categories perform work or supply services under a contract awarded by the Province.

Minimum wage

4On and after April 1, 2019, the minimum wage payable to an employee in a category listed in Column I of Schedule A shall be the greater of

(a) the minimum wage per hour listed in Column II of Schedule A, and

(b) the minimum wage per hour payable to an employee under the Minimum Wage Regulation – Employment Standards Act.

Categories of employees not listed in Schedule

5On and after April 1, 2019, the minimum wage payable to an employee in a category not listed in Column I of Schedule A shall be the greater of

(a) the minimum wage per hour payable to a Labourer as set out in Column II of Schedule A, and

(b) the minimum wage per hour payable to an employee under the Minimum Wage Regulation – Employment Standards Act.

Maximum number of hours of work at a minimum wage

6(1)The maximum number of hours of work for employees employed in Crown building construction for which the minimum wage fixed under section 4 or 5 shall be paid is 44 hours per week.

6(2)The maximum number of hours of work for employees employed in Crown road and bridge construction for which the minimum wage fixed under section 4 or 5 shall be paid is 50 hours per week.

Minimum wage for excess time worked

7(1)The minimum wage payable for time worked in excess of the maximum number of hours fixed under subsection 6(1) is one and one-half times the minimum wage fixed under section 4 or 5.

7(2)The minimum wage payable for time worked in excess of the maximum number of hours fixed under subsection 6(2) is one and one-half times the minimum wage fixed under section 4 or 5.

Repeal

8New Brunswick Regulation 90-149 under the Employment Standards Act is repealed.

Commencement

9This Regulation comes into force on July 1, 2007.
