Under section 18, on the recommendation of the Minister, and sections 34 and 41 of the Natural Products Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Blueberry Plan and Levies Regulation - Natural Products Act.
Definitions
2The following definitions apply in this Regulation.
“Act” means the Natural Products Act. (Loi)
“Agency” means Bleuets NB Blueberries. (Agence)
“Plan” means the plan set out in Part 1. (Plan)
“regulated area” means the area specified in section 6. (zone réglementée)
“regulated product” means the farm product specified in section 5. (produit réglementé)

PLAN
Purpose of Part
3The purpose of this Part is to establish a plan for the Agency established for the purposes set out in section 7.
Application of Plan
4The Plan applies to all persons engaged in producing the regulated product in the regulated area.
Regulated product
5For the purposes of this Regulation, the regulated product is blueberries.
Regulated area
6For the purposes of this Regulation, the regulated area is the Province.
Purposes for establishment of Agency
7The purposes for which the Agency is established are:
(a) the promotion of the consumption and use of the regulated product; and
(b) research activities pertaining to the regulated product.
Mission statement and strategic objectives of Agency
8The mission statement and strategic objectives of the Agency are:
(a) through communications, liaison, research and education, to represent blueberry producers to other sectors of the blueberry industry, consumers and the public, with respect to all matters concerning the promotion of the consumption and use of the regulated product; and
(b) to encourage the development of efficient and competitive practices within the industry.
Financing
9The levies and charges authorized to be imposed under this Regulation shall be used to finance the operation of the Plan.

POWERS OF AGENCY
Powers of Agency
10The powers of a corporation under the Business Corporations Act are vested in the Agency, and, subject to the Act, in the exercise of such powers the members of the Agency shall be deemed to be its shareholders and directors.

LEVIES AND CHARGES
Levies and charges
11The Agency is authorized:
(a) to fix levies or charges and to impose them on and collect them from persons engaged in the production of the whole or any part of the regulated product;
(b) for the purposes of paragraph (a), to classify the persons referred to in that paragraph into groups and fix the levies or charges payable by the members of the different groups in different amounts; and
(c) to use the levies or charges under paragraph (a) for the purposes of the Agency, including expenses of the Agency and promotion and research activities.

COMMENCEMENT
Commencement
12This Regulation comes into force on August 1, 2006.
N.B. This Regulation is consolidated to June 16, 2023.
