Under section 56 of the Financial Administration Act, the Lieutenant-Governor in Council, on the recommendation of the Board, makes the following Regulation:

Citation
1This Regulation may be cited as the Fees for Services at the Dairy Laboratory - Financial Administration Act.
Definitions
2The following definitions apply in this Regulation.
“Department” means the Department of Agriculture, Aquaculture and Fisheries.(ministère)
“milk” means milk from cows. (lait)
“milk product” means a product processed or derived in whole or mainly from milk. (produit du lait)
“raw milk” means unprocessed milk. (lait cru)

Microbiological laboratory analysis
3(1)The fees set out in Schedule A are the fees for microbiological laboratory analysis of raw milk or milk products by the Department.
3(2)Despite subsection (1), where more than one microbiological laboratory analysis is conducted on the same sample, the fee for each analysis conducted after the first analysis shall be reduced by $5.00.
Antibiotic screening analysis
4(1)The fees set out in Schedule B are the fees for antibiotic screening analysis of raw milk or milk products by the Department.
4(2)The fee for an antibiotic confirmation analysis of raw milk or milk products that is not performed by the Department is the fee charged by the reference laboratory.
Composition laboratory analysis
5The fees set out in Schedule C are the fees for composition laboratory analysis of milk products by the Department.
Complete laboratory analysis
6(1)The fee for a complete laboratory analysis of raw milk is $87.50, including shipping.
6(2)A complete laboratory analysis of a sample of raw milk consists of the following analyses:
(a) standard plate count;
(b) laboratory pasteurization count;
(c) streptococcus count;
(d) oxidase positive count;
(e) coliform count (Spiral plate);
(f) fat, protein and lactose content;
(g) somatic cell count; and
(h) added water (cryoscope method).
Dairy herd
7The fees set out in Schedule D are the fees for the laboratory analysis of milk from a dairy herd by the Department.
Commencement
8This Regulation comes into force on April 1, 2005.
