Under subsection 192(1) of the
Municipalities Act
, the Lieutenant-Governor in Council makes the following Regulation:

Definitions

The following definitions apply in this Regulation.
“Act”
means the
Municipalities Act
.
(Loi)
“procedural by-law”
means a by-law enacted pursuant to subsection 10.3(1) of the Act.
(arrêté procédural)
Procedural by-law

A procedural by-law shall include, but not be limited to, the following:
(
a
)
the day of the week on which regular meetings of council shall be held and the frequency at which regular meetings of council shall be held;
(
b
)
the time at which regular meetings of council shall be held;
(
c
)
the location at which regular meetings of council shall be held;
(
d
)
the manner in which the public shall be notified of regular meetings of council;
(
e
)
rules respecting the manner in which members of council and members of the public shall conduct themselves at meetings of council;
(
f
)
the manner in which members of the public may participate in meetings of council;
(
g
)
the manner in which a deputy mayor shall be elected under section 30 of the Act and the duration of the term of a deputy mayor;
(
h
)
the Order of the Day for regular meetings of council;
(
i
)
the manner in which a council may call special meetings of council and emergency meetings of council; and
(
j
)
the procedural text that council shall use to govern matters of procedure that arise during a meeting of council that are not otherwise provided for in the Act or the procedural by-law.
Application to rural community

3.1
Section 3 applies with the necessary modifications to a by-law enacted by a rural community pursuant to subsection 190.079(2) of the Act.

Enactment of procedural by-law

A municipality shall enact a procedural by-law on or before October 31, 2004.
Commencement
5
This Regulation comes into force on May 1, 2004.
