An Act to Amend the
Medical Consent of Minors Act
Assented to June 11, 2021
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1Section 3 of the Medical Consent of Minors Act, chapter M-6.1 of the Acts of New Brunswick, 1976, is amended
(a) in subsection (1)
(i) by repealing the portion preceding paragraph (a) and substituting the following: 
3(1)The consent to medical treatment of a minor who has not attained 16 years of age is as effective as it would be if the minor had attained the age of majority if, in the opinion of a legally qualified medical practitioner, dentist, nurse practitioner, nurse, licensed practical nurse or midwife attending the minor,
(ii) in paragraph (b) of the English version by striking out “and his” and substituting “and the minor’s”;
(b) in subsection (2)
(i) by repealing the portion preceding paragraph (a) of the English version and substituting the following:
3(2)The consent of a minor who has not attained 16 years of age or of the minor’s parent or guardian, if they are unavailable, is not required in relation to medical treatment performed with respect to that minor if
(ii) in paragraph (a) of the English version by striking out “his consent” and substituting “their consent”;
(iii) in paragraph (b) by striking out “midwife or nurse” and substituting “nurse, licensed practical nurse or midwife”.
2Section 5 of the English version of the Act is amended by striking out “his medical treatment” and substituting “medical treatment of the minor”.
