An Act to Amend the
Assessment Act
Assented to December 18, 2020
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1Subsection 4(1) of the Assessment Act, chapter A-14 of the Revised Statutes, 1973, is amended
(a) in paragraph (l) of the English version by striking out “and” at the end of the paragraph;
(b) in subparagraph (m)(ii) by striking out the period at the end of the subparagraph and substituting “; and”;
(c) by adding after paragraph (m) the following: 
(n) real property or portions of real property occupied by a public transit system prescribed by regulation that is operated by or on behalf of one or more local governments primarily within the territorial limits of the local government or local governments.
2Subsection 40(1) of the Act is amended by adding the following after paragraph (e.43): 
(e.44) prescribing public transit systems for the purposes of paragraph 4(1)(n);
Regulation under the Assessment Act
3New Brunswick Regulation 84-6 under the Assessment Act is amended by adding after section 2.211 the following: 
2.212The following public transit systems are prescribed for the purposes of paragraph 4(1)(n) of the Act: 
(a) Codiac Transpo, operated by the city of Moncton on its own behalf and on behalf of the city of Dieppe and The Town of Riverview;
(b) Saint John Transit, operated by the Saint John Transit Commission on behalf of The City of Saint John; and
(c) Fredericton Transit, operated by The City of Fredericton.
Commencement
4This Act shall be deemed to have come into force on January 1, 2020.
