An Act to Amend the
Seafood Processing Act
Assented to December 20, 2019
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1Subsection 5(1) of the Seafood Processing Act, chapter S-5.3 of the Acts of New Brunswick, 2006, is amended by repealing paragraph (a) and substituting the following: 
(a) holds a registration or licence under the Safe Food for Canadians Act (Canada), and
2Section 6 of the Act is amended by repealing paragraph (a) and substituting the following: 
(a) the applicant does not hold the registration or licence or have the certification referred to in subsection 5(1), or
3Subsection 8(1) of the Act is amended by repealing paragraph (a) and substituting the following: 
(a) the applicant does not hold the registration or licence referred to in paragraph 5(1)(a) or, subject to section 16.93, have the certification required in accordance with the regulations,
4Section 14 of the Act is amended by repealing paragraph (a) and substituting the following: 
(a) the licensee does not hold the registration or licence referred to in paragraph 5(1)(a) or, subject to section 16.93, have the certification required in accordance with the regulations,
5Subsection 16.1(1) of the Act is amended by repealing paragraph (a) and substituting the following: 
(a) holds a registration or licence under the Safe Food for Canadians Act (Canada),
6Subsection 16.3(1) of the Act is amended by repealing paragraph (a) and substituting the following:
(a) holds a registration or licence under the Safe Food for Canadians Act (Canada), and
7Section 16.31 of the Act is amended by repealing paragraph (a) and substituting the following:
(a) the applicant does not hold the registration or licence or have the certification referred to in subsection 16.3(1), or
8Subsection 16.33(1) of the Act is amended by repealing paragraph (a) and substituting the following:
(a) the licensee does not hold the registration or licence referred to in paragraph 16.3(1)(a), or, subject to section 16.93, have the certification required in accordance with the regulations,
9Section 16.44 of the Act is amended by repealing paragraph (a) and substituting the following:
(a) the licensee does not hold the registration or licence referred to in paragraph 16.3(1)(a), or, subject to section 16.93, have the certification required in accordance with the regulations,
10Subsection 16.51(1) of the Act is amended by repealing paragraph (a) and substituting the following:
(a) holds a registration or licence under the Safe Food for Canadians Act (Canada),
11Subsection 16.6(1) of the Act is amended by repealing paragraph (a) and substituting the following:
(a) holds a registration or licence under the Safe Food for Canadians Act (Canada), and
12Section 16.61 of the Act is amended by repealing paragraph (a) and substituting the following:
(a) the applicant does not hold the registration or licence or have the certification referred to in subsection 16.6(1), or
13Subsection 16.63(1) of the Act is amended by repealing paragraph (a) and substituting the following:
(a) the licensee does not hold the registration or licence or have the certification referred to in paragraph 16.6(1)(a) or, subject to section 16.93, have the certification required in accordance with the regulations,
14Section 16.8 of the Act is amended by repealing paragraph (a) and substituting the following:
(a) the licensee does not hold the registration or licence or have the certification referred to in paragraph 16.6(1)(a) or, subject to section 16.93, have the certification required in accordance with the regulations,
15Subsection 16.82(1) of the Act is amended by repealing paragraph (a) and substituting the following:
(a) holds a registration or licence under the Safe Food for Canadians Act (Canada),
16Subsection 67(3) of the Act is amended by repealing paragraph (d) and substituting the following:
(d) registrations or licences under the Safe Food for Canadians Act (Canada);
17Subsection 67(4) of the Act is amended by repealing paragraph (d) and substituting the following:
(d) registrations or licences under the Safe Food for Canadians Act (Canada);
Commencement
18This Act or any provision of it comes into force on a day or days to be fixed by proclamation.
