An Act to Amend the
Enforcement of Money Judgments Act
Assented to June 14, 2019
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1Section 1 of the Enforcement of Money Judgments Act, chapter 23 of the Acts of New Brunswick, 2013, is amended
(a) by repealing the definition “exempt”;
(b) in the French version in the definition « compte » by striking out “payable” and substituting “à payer”;
(c) in the French version in the definition « montant recouvrable »
(i) in paragraph a) by striking out “le montant impayé du jugement” and substituting “le reliquat à satisfaire sur le montant du jugement”;
(ii) in paragraph c) by striking out “payables” and substituting “à payer”.
2Subsection 10(4) of the French version of the Act is amended in the portion preceding paragraph (a) by striking out “exécuter le jugement” and substituting “satisfaire au jugement”.
3Section 13 of the French version of the Act is amended
(a) in subsection (1) by striking out “assurer l’exécution du jugement” and substituting “satisfaire au jugement”;
(b) in subsection (5) by striking out “exécuter le jugement” and substituting “satisfaire au jugement”.
4Subsection 16(3) of the French version of the Act is amended by striking out “l’exécution du jugement” and substituting “jusqu’à ce qu’il ait été satisfait au jugement”.
5Paragraph 23(1)a) of the French version of the Act is repealed and the following is substituted:
(a) il a été satisfait au jugement qui fait l’objet de l’enregistrement ou ce jugement a été annulé ou est inexécutoire;
6Paragraph 33(1)b) of the French version of the Act is repealed and the following is substituted:
(b) la capacité du débiteur judiciaire à satisfaire au jugement.
7Subsection 35(1) of the Act is amended
(a) in paragraph (b) of the English version by adding “and” at the end of the paragraph;
(b) in paragraph (c) by striking out “, and” and substituting a period;
(c) by repealing paragraph (d).
8Paragraph 44(1)a) of the French version of the Act is repealed and the following is substituted: 
(a) une ordonnance de la cour accorde libération totale ou partielle du jugement ou il a été satisfait au jugement, en tout ou en partie, par un paiement ou un transfert de biens;
9Subsection 46(1) of the French version of the Act is amended
(a) in paragraph a) by striking out “pour exécuter le jugement” and substituting “pour satisfaire au jugement”;
(b) in paragraph d) by striking out “afin d’exécuter le jugement” and substituting “pour satisfaire au jugement”.
10Section 52 of the Act is amended
(a) by repealing subsection (1) of the French version and substituting the following: 
52(1)Le shérif peut exiger du débiteur judiciaire qu’il fournisse des renseignements sur ses biens et sur sa capacité à satisfaire au jugement.
(b) in subsection (2) by striking out “the exemptions from realization” and substituting “the exemption from seizure under section 84.1 and the exemptions from realization under section 85”.
11Section 53 of the Act is amended by striking out “is or may be exempt” and substituting “is exempt from seizure under section 84.1 and property that is or may be exempt from realization under section 85”.
12Section 57 of the Act is amended by repealing the portion preceding paragraph (a) and substituting the following: 
57Subject to section 84.1, for the purpose of enforcing a judgment, a sheriff may seize
13Subsection 58(3) of the Act is repealed and the following is substituted: 
58(3)Property that is or may be exempt from realization under section 85 may only be seized under paragraph (1)(b) or (c).
14Subsection 64(1) of the Act is amended
(a) in paragraph (b) by striking out “the property is exempt” and substituting “the property is exempt from realization under section 85”;
(b) by repealing paragraph c) of the French version and substituting the following: 
(c) il a été satisfait au jugement;
(c) by repealing paragraph d) of the French version and substituting the following: 
(d) il sera satisfait au jugement par la réalisation d’autres biens pour lesquels le shérif ne donne pas mainlevée de saisie.
15Section 74 of the French version of the Act is amended
(a) in subsection (5) by striking out “payables” and substituting “à verser”;
(b) in subsection (7) by striking out “exécuter le jugement” and substituting “satisfaire au jugement”.
16Subsection 80(1) of the French version of the Act is amended
(a) in the portion preceding paragraph a) by striking out “payable” and substituting “exigible”;
(b) in paragraph a) by striking out “payable” and substituting “exigible”;
(c) in paragraph b) by striking out “payable” and substituting “exigible”;
(d) in subparagraph c)(ii) by striking out “payable” and substituting “exigible”.
17Section 81 of the Act is amended
(a) in subsection (2) by striking out “that is exempt” and substituting “that is exempt from realization under section 85”;
(b) by repealing subsection (5) of the French version and substituting the following: 
81(5)L’ordre de paiement enjoint à l’employeur : 
(a) de déduire des sommes dues au débiteur judiciaire et qui sont exigibles, ou qui le deviendront, le montant indiqué dans l’ordre de paiement conformément au calendrier qui y est donné;
(b) de verser au shérif la somme qui représente la déduction.
18Subsection 82(1) of the French version of the Act is amended in the portion preceding paragraph a) by striking out “payable” and substituting “à payer”.
19The Act is amended by adding after section 84 the following: 
Property exempt from seizure
84.1(1)The property of a judgment debtor in a retirement fund is exempt from seizure.
84.1(2)A payment to a judgment debtor out of a retirement fund is not exempt from seizure.
84.1(3)A transfer of the property of a judgment debtor in a retirement fund to another retirement fund is not considered to be a payment out of a retirement fund for the purposes of subsection (2).
84.1(4)A payment referred to in subsection (2) is considered to be income for the purposes of paragraph 85(g).
20The heading “Exemptions” preceding section 85 of the Act is repealed and the following is substituted:
Property exempt from realization
21Section 85 of the Act is amended
(a) in paragraph (f) of the English version by adding “and” at the end of the paragraph;
(b) in paragraph (g) by striking out “; and” and substituting a period;
(c) by repealing paragraph (h).
22Section 86 of the Act is amended
(a) by repealing subsection (1) and substituting the following: 
86(1)The sheriff shall determine the existence and extent of any exemption from realization under section 85, and shall notify the judgment debtor.
(b) in subsection (4) by striking out “is exempt” and substituting “is exempt from realization under section 85”;
(c) by repealing subsection (5).
23Section 87 of the Act is amended by striking out “paragraphs 85(a) to (h)” and substituting “paragraphs 85(a) to (g)”.
24Section 88 of the Act is amended by striking out “paragraphs 85(a) to (h)” and substituting “paragraphs 85(a) to (g)”.
25Section 90 of the Act is amended by repealing the portion preceding paragraph (a) and substituting the following: 
90Nothing in this Part prevents a sheriff from realizing on any property of a judgment debtor of a kind described in paragraphs 85(a) to (g) if
26Section 94 of the French version of the Act is repealed and the following is substituted: 
94S’il peut déterminer la somme à payer au titre de l’un des alinéas de l’article 91 ou 92, mais qu’il ne peut déterminer les priorités de rang ou les droits entre les réclamations qui relèvent du même alinéa, le shérif peut la consigner à la cour et effectuer les paiements au titre des autres alinéas.
27Paragraph 100(h) of the Act is repealed and the following is substituted: 
(h) establishing requirements for obtaining leave of the court for actions taken under the Act, establishing criteria for granting that leave and authorizing the court to impose terms and conditions when granting leave;
