An Act to Amend the
Executive Council Act
Assented to March 29, 2019
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
Executive Council Act
1Section 2 of the Executive Council Act, chapter 152 of the Revised Statutes, 2011, is repealed and the following is substituted:
2Under the Great Seal of the Province, the Lieutenant-Governor in Council may appoint from among the members of the Executive Council the following Ministers who shall hold office during pleasure: a President of the Executive Council, a Minister of Aboriginal Affairs, a Minister of Agriculture, Aquaculture and Fisheries, a Minister of Economic Development and Small Business, a Minister of Education and Early Childhood Development, a Minister of Energy and Resource Development, a Minister of Environment and Local Government, a Minister of Finance, a Minister of Health, a Minister of Intergovernmental Affairs, a Minister of Justice who shall also be Attorney General, a Minister of Post-Secondary Education, Training and Labour, a Minister of Public Safety who shall also be Solicitor General, a Minister of Service New Brunswick, a Minister of Social Development, a Minister of Tourism, Heritage and Culture, a Minister of Transportation and Infrastructure, and a President of Treasury Board.
TRANSITIONAL PROVISIONS
References to Ministers, Deputy Ministers and Departments
2(1)When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister of Agriculture, Mines and Rural Affairs, it shall be read, unless the context otherwise requires, as a reference to the Minister of Agriculture, Aquaculture and Fisheries.
2(2)When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister of Aquaculture and Fisheries, it shall be read, unless the context otherwise requires, as a reference to the Minister of Agriculture, Aquaculture and Fisheries.
2(3)When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister or Department of Economic Development, it shall be read, unless the context otherwise requires, as a reference to the Minister or Department of Economic Development and Small Business.
2(4)When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister of Families and Children, it shall be read, unless the context otherwise requires, as a reference to the Minister of Social Development.
2(5)When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister, Deputy Minister or Department of Justice and Public Safety, it shall be read, unless the context otherwise requires, as a reference to
(a) the Minister or Deputy Minister of Justice or to the Department of Justice and Office of the Attorney General, or
(b) the Minister or Deputy Minister of Public Safety or to the Department of Public Safety,
as the case may be.
2(6)When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister of Labour, Employment and Population Growth, it shall be read, unless the context otherwise requires, as a reference to the Minister of Post-Secondary Education, Training and Labour.
2(7)When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Office of the Attorney General, it shall be read, unless the context otherwise requires, as a reference to the part of the Department of Justice and Office of the Attorney General that includes the Legal Services Branch, the Legislative Services Branch, the Family Crown Services Branch and the Public Prosecution Services Branch.
2(8)When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister of Post-Secondary Education, it shall be read, unless the context otherwise requires, as a reference to the Minister of Post-Secondary Education, Training and Labour.
2(9)When, in an Act, other than this Act, or in any regulation, rule, order, by-law, agreement or other instrument or document, reference is made to the Minister of Seniors and Long-Term Care, it shall be read, unless the context otherwise requires, as a reference to the Minister of Social Development.
Confirmation and ratification
3(1)Any act or thing done from November 10, 2018, to the date of the enactment of this section, both dates inclusive, by the Minister of Aboriginal Affairs, the Minister of Agriculture, Aquaculture and Fisheries, the Minister of Economic Development and Small Business, the Minister of Intergovernmental Affairs, the Minister of Justice, the Minister of Post-Secondary Education, Training and Labour, the Minister of Public Safety, and the Minister of Social Development, in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those Ministers with respect to any Act, or any particular matter or thing under the administration, supervision or control of those Ministers
(a) shall be deemed to have been done by persons validly appointed to exercise or perform the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those Ministers,
(b) shall be deemed to constitute a valid exercise or performance of the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those Ministers, and
(c) is confirmed and ratified.
3(2)Nothing in paragraphs (1)(a) and (b) shall be taken as providing any indication that any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Ministers referred to in subsection (1) was not validly exercised or performed.
Appointments, confirmation and ratification – deputy heads
4(1)The Lieutenant-Governor in Council may make the initial appointments of deputy heads under section 3 of the Civil Service Act retroactive to November 10, 2018, for the Department of Aboriginal Affairs, the Department of Intergovernmental Affairs, the Department of Economic Development and Small Business, the Department of Justice and Office of the Attorney General and the Department of Public Safety.
4(2)Any act or thing done by the deputy heads appointed in accordance with subsection (1) from November 10, 2018, to the date of the enactment of this section, both dates inclusive, in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those deputy heads,
(a) shall be deemed to have been done by persons validly appointed to exercise or perform the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those deputy heads,
(b) shall be deemed to constitute a valid exercise or performance of the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those deputy heads, and
(c) is confirmed and ratified.
4(3)Nothing in paragraphs (2)(a) and (b) shall be taken as providing any indication that any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the deputy heads appointed in accordance with subsection (1) was not validly exercised or performed.
Immunity – Ministers and deputy heads
5No action, application or any other proceeding to question or in which is questioned the validity of the appointment of the Ministers referred to in subsection 3(1) or the deputy heads appointed in accordance with subsection 4(1), or the authority of those Ministers or deputy heads to act in that capacity, lies or shall be instituted against
(a) the Crown in right of the Province,
(b) the Ministers referred to in subsection 3(1), with respect to any act or thing done from November 10, 2018, to the date of the enactment of this section, both dates inclusive, by those Ministers in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those Ministers with respect to any Act, or any particular matter or thing under the administration, supervision or control of those Ministers,
(c) the deputy heads appointed in accordance with subsection 4(1), with respect to any act or thing done by those deputy heads from November 10, 2018, to the date of the enactment of this section, both dates inclusive, in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on those deputy heads, or
(d) any other person appointed, assigned, designated or requested to assist those Ministers or the deputy heads regarding the administration, supervision or enforcement of any Act with respect to which any right, power, duty, function, responsibility or authority is transferred to, vested in or imposed on those Ministers, regarding a particular matter or thing under the administration, supervision or control of those Ministers, or regarding any right, power, duty, function, responsibility or authority that is transferred to, vested in or imposed on those deputy heads, with respect to any act or thing done, within the meaning of this paragraph, by the other person,
if those Ministers, deputy heads or other persons acted in good faith in doing the act or thing.
CONSEQUENTIAL AMENDMENTS
Adult Education and Training Act
6Section 1 of the Adult Education and Training Act, chapter 101 of the Revised Statutes, 2011, is amended in the definition “Minister” by striking out “Post-Secondary Education” and substituting “Post-Secondary Education, Training and Labour”.
Agricultural Commodity Price Stabilization Act
7Section 1 of the Agricultural Commodity Price Stabilization Act, chapter 105 of the Revised Statutes, 2011, is amended in the definition “Minister” by striking out “Aquaculture and Fisheries” and substituting “Agriculture, Aquaculture and Fisheries”.

An Act to Amend theFamily Services Act
55(1)Section 3 of an Act to Amend the Family Services Act, chapter 8 of the Acts of New Brunswick, 2010, is amended by repealing section 13, as enacted by section 3, and substituting the following:
13If the Minister considers it to be in the best interests of the child to do so, the Minister may prohibit in writing any person from visiting, writing to, telephoning or otherwise communicating with a child in care, the child’s parent, foster parent or kinship caregiver, and any person who violates a prohibition in writing executed under this section having been given notice of the prohibition, or who otherwise in any way interferes with a child in care without the consent of the Minister, commits an offence.

145Section 24 of the Vital Statistics Act, chapter V-3 of the Acts of New Brunswick, 1979, is amended
(a) in subsection (5) by striking out “Minister of Families and Children” wherever it appears and substituting “Minister of Social Development”;
(b) in subsection (6) by striking out “Minister of Families and Children” and substituting “Minister of Social Development”.
Regulation under the Vital Statistics Act
146New Brunswick Regulation 87-30 under the Vital Statistics Act is amended
(a) in paragraph 11.5(e) by striking out “Minister of Families and Children or the Minister of Seniors and Long-Term Care, as the case may be,” and substituting “Minister of Social Development”;
(b) in paragraph 11.6(e) by striking out “Minister of Families and Children or the Minister of Seniors and Long-Term Care, as the case may be,” and substituting “Minister of Social Development”.
Vocational Rehabilitation of Disabled Persons Act
147Section 1 of the Vocational Rehabilitation of Disabled Persons Act, chapter 234 of the Revised Statutes, 2011, is amended in the definition “Minister” by striking out “Minister of Families and Children” and substituting “Minister of Social Development”.

148Section 1 of the Women’s Institute and Institut féminin Act, chapter 136 of the Revised Statutes, 2014, is amended in the definition “Minister” by striking out “Aquaculture and Fisheries” and substituting “Agriculture, Aquaculture and Fisheries”.
Workplace Health, Safety and Compensation Commission and Workers’ Compensation Appeals Tribunal Act
149Section 1 of the Workplace Health, Safety and Compensation Commission and Workers’ Compensation Appeals Tribunal Act, chapter W-14 of the Acts of New Brunswick, 1994, is amended in the definition “Minister” by striking out “Post-Secondary Education” and substituting “Post-Secondary Education, Training and Labour”.
